Pivić: Konaković pushed a bad law for the country for a 'checkmark' in Brussels

(Patria) - Federal MP Nezir Pivić (SDA) commented on the claim by the Minister of Foreign Affairs of BiH and leader of People and Justice (NIP) Elmedin Konaković that the Draft Law on Courts of BiH has contentious points regarding the seat of the Higher Court and the criminal jurisdiction of the Court of BiH.

According to Pivić, there would be nothing contentious in this statement if the Minister of Foreign Affairs had not, less than two weeks ago, claimed that the only contentious provision of the Draft Law on Courts of BiH was the one allegedly discriminating against female judges of Islamic faith, stating that those wearing hijabs would not be able to perform their duties because the law would not allow it.

"From the perspective of constitutional law and the instruments for the protection of human rights embedded in the Constitution of Bosnia and Herzegovina, such a provision is impossible and inadmissible.

On the other hand, the Minister of Foreign Affairs should re-examine his personal and moral responsibility because he not only stated an untruth but also grossly misused the religious feelings and pride of believers to defend his ignorance and poor political compromises at the expense of the state.

The Minister of Foreign Affairs should also answer the question of how it is that two weeks ago, within the same text of the Draft Law on Courts of Bosnia and Herzegovina, the criminal jurisdiction of the Court of Bosnia and Herzegovina and the seat of the Higher Court were not contentious, or were they, and the minister resorted to misusing religious feelings to cover it up and push through a law that is bad for the country for a 'checkmark' in Brussels?

I have warned about the harmfulness of this Draft and the danger that threatens the state of Bosnia and Herzegovina due to the reduction of the criminal jurisdiction of the Court and Prosecutor's Office of Bosnia and Herzegovina.

The European Union expects the Supreme Court of Bosnia and Herzegovina to be established as the fourth judicial instance at the state level, responsible for harmonizing judicial practice and ensuring the equal application of law throughout the country.

However, those in power should prioritize what is in the best interest of the state of Bosnia and Herzegovina and its citizens over what the European Union thinks. Quality legal solutions must always take precedence over political compromises, and the well-being of the state must take precedence over anyone's 'checkmarks'," Pivić wrote on social media.
