Parliament of FBiH: Are there any reliefs for sports clubs from 2017 to 2020?

SARAJEVO, (Patria) - The 14th regular session of the House of Representatives of the Parliament of FBiH is being held today, and the proposed agenda includes several legal solutions, including urgent procedures, the Report on the Execution of the FBiH Budget for 2019, the Annual Report on the Operations of the Public Enterprise "Railways of the Federation of BiH" for 2016, 2017, and 2018.

The agenda includes the Bill on Amending the Law on the Securities Commission (urgent procedure), the Bill on Amendments to the Law on Protection of Financial Services Users – urgent procedure, the Bill on Amendments to the Law on Internal Payment Transactions – urgent procedure, the Bill on Amending the Law on Collection and Partial Write-off of Debts to Sports Collectives, proposed by the parliamentary groups of SDA, HDZ BiH-HNS, DF, and SBB – urgent procedure.

The proposers stated in the explanation that the amendment relates to the date of 31.12.2016 and that it should be changed to 30.06.2020 because a large number of sports clubs and collectives are in a difficult financial situation, especially during the coronavirus pandemic, which makes their operations and competitions difficult.

"Therefore, the need to amend and supplement the Law is justified, in a way that the conditions, manner, and procedure related to due but uncollected tax debts of sports clubs and the write-off of default interest are linked, instead of to 31.12.2016, to 30.06.2020 as a reference time value for which the occurrence of appropriate legal consequences is tied. From the foregoing, it undoubtedly follows that the main reason for adopting the Law on Amendments to the Law is primarily the systematic provision and normalization of the operations of sports collectives as taxpayers, and overcoming the limiting factor of their operations - the settlement of tax debts, all in order to adequately resolve the existing financial difficulties they have faced in the period from 31.12.2016 to date," the explanation states.

Representatives should also consider the Bill on the Register of Financial Reports, the Bill on Accounting and Auditing, the Bill on Amendments to the Law on Fiscal Systems, the Draft Regulatory Plan of the Historical Urban Area of Blagaj for the period of ten years from the date of adoption, and the Report on the Work of FERK for 2019.
