Paradox and precedent that everything in RS is subordinated to the entity president must not become a rule!

(Patria) - Ramiz Salkić, a deputy in the National Assembly of the RS, said today, October 26, 2023, reacting to the statement of the President of the NSRS Nenad Stevandić in which he said that the RS has solutions that can ban Dodik from attending court proceedings, that these are dangerous announcements indicating further radicalization of the situation in this entity and jeopardizing the functioning of the separate judiciary in Bosnia and Herzegovina, which will
affect the overall security situation in the country.

- Today, the President of the NSRS announced: "Do not think that we in the RS do not have our own solutions and that we are not able to ban Dodik from attending court proceedings, through legal assembly decisions."

This is clear evidence of the intentions of the current authorities in the entity of RS to exert pressure, influence and interference of the legislative part of the lower level of government in the work of the Court of Bosnia and Herzegovina.

These are dangerous announcements indicating further radicalization of the situation in this entity and jeopardizing the functioning of the separate judiciary in Bosnia and Herzegovina, which will affect the overall security situation in the country.

Such announcements are proof of disrespect for the Constitution of Bosnia and Herzegovina and the Dayton Peace Agreement, and are aimed at creating pressure on the Court of Bosnia and Herzegovina in the absence of arguments and evidence for the successful defense of their beloved president.

To this end, in order to create a general climate of distrust, concern and fear among citizens, gatherings of the authorities and budget beneficiaries have been held these days in Trebinje, Zvornik, and will be held in other cities as well, disturbing citizens and causing unrest among them. The announcement of a possible decision by the NSRS that the president of the entity RS is obliged not to appear before the Court of Bosnia and Herzegovina will have no legal force, but it represents a very serious violation of the Constitution and all those who vote for it should be treated as such, because they violate the oath they took to respect the Constitution and laws of Bosnia and Herzegovina and the RS.

According to Stevandić, such a decision is legal, which is debatable from the position that it is illegal and unconstitutional, because it is contrary to the Constitution and the law under which all citizens are equal regardless of the position they hold today in the entity RS or some other level of government. On the other hand, it is unacceptable for the legislative authority at any level to interfere in the work of the judiciary and thereby violate the Constitution of Bosnia and Herzegovina and the principle of separation of powers into judicial, legislative and executive.
