Indictment for the criminal offense of illegal trade in excise goods

A prosecutor from the Second Department of the BiH Prosecutor's Office has filed an indictment against Kasim Golubović, born in 1966 in Golubovići, municipality of Velika Kladuša, a citizen of BiH.

According to the indictment, Golubović is accused of transporting a larger quantity of cut tobacco on June 19, 2017, for the purpose of acquiring unlawful property gain, with the intention of putting it on the market, which was not marked with excise stamps as prescribed by the tax legislation of BiH.

On the mentioned day, in the evening hours, on the M14 highway Novi Grad – Bosanska Krupa, in the town of Bosanska Otoka, in the border area of Bosnia and Herzegovina and the Republic of Croatia, the accused transported 120.036 kg of cut tobacco packed in PVC bags in the trunk of a passenger motor vehicle, which he had previously obtained from a person known to him in the Banja Luka market.

During the inspection of the vehicle in question, authorized officials of the BiH Border Police confiscated the aforementioned tobacco, which was intended for sale on the black market.

The amount of tax and excise duty per kilogram of cut tobacco is around 100 KM, so the smuggling of approximately 120 kilograms causes damage to the BiH budget of around 10,000 KM.

The accused is charged with committing the criminal offense of illegal trade in excise goods from Article 210a in conjunction with Article 26 of the Criminal Code of BiH.

The indictment has been forwarded to the BiH Court for confirmation.
