The Federal Administrative Inspection of the Ministry of Justice of the Federation of Bosnia and Herzegovina has determined unlawful conduct by the Mayor of Ilidža Municipality, Senaid Memić, and has issued an order for him to urgently resolve the requests of JP Autoceste FBiH, according to a statement from JP Autoceste FBiH, reports Patria.
Namely, during an inspection of the case files, the administrative inspector determined that the Mayor of Ilidža and the competent municipal service grossly violated the Law on Administrative Procedure. The municipal mayor not only ignored the request for the complete expropriation of real estate for the needs of the LOT 3B highway section, which JP Autoceste FBiH submitted back in 2012, but also ordered the suspension of expropriation in that area.
A month ago, by the arbitrary decision of Mayor Senaid Memić, the expropriation of real estate on the Sarajevo Bypass LOT 3B was suspended, jeopardizing the construction of the highway on Corridor Vc, which is a project of state interest.
The disputed decision also violated the Law on Expropriation, which stipulates that expropriation for the construction of transport infrastructure has priority over other expropriation procedures, as it is in the general interest of the Federation of Bosnia and Herzegovina, the statement said.
