OHR: Constitutional Court of BiH will assess the constitutionality of the law passed by the National Assembly of RS

(Patria) - The adoption of amendments to the Law on the Use of the Flag, Coat of Arms and Anthem in Republika Srpska aims to implement the declaration of the All-Serbian Assembly in order to create a legal basis for the display of the official anthem and coat of arms of the Republic of Serbia in Republika Srpska as all-Serbian symbols, it was stated to Fena from the OHR after the draft of this law was adopted by the National Assembly of RS last week.

The OHR reminds that the Constitutional Court of BiH has already declared these same symbols, which were then designated as the official coat of arms and anthem of RS, unconstitutional. The Court explained that these official symbols are in conflict with the constitutional principle of collective equality of constituent peoples, as they emphasize the history, tradition, customs, and religious and national identity of Serbs, and impose such values on members of other constituent peoples, other citizens, and others in the territory of Republika Srpska.

“It will be up to the Constitutional Court of BiH to assess the constitutionality of the law in light of its previous court practice,” the OHR stated.
