Ignored the Decision of the Constitutional Court of BiH: SDP and DF Submitted a Request for the Dismissal of Pendeš, Jusić and Jerinić

State representatives of the SDP BiH and the Democratic Front Damir Bećirović, Željko Komšić, Mensura Beganović, Hanka Vajzović, Maja Gasal – Vražalica, Saša Magazinović, Mirsad Mešić and Denis Bećirović have submitted to the Speaker of the House of Representatives of the Parliamentary Assembly of BiH, Šefik Džaferović, a request to initiate a vote on the need for reconstruction of the Council of Ministers of BiH, specifically to vote on the dismissal of the Minister of Defense of BiH Marina Pendeš as well as her deputies Sead Jusić and Boris Jerinić, Patria reports.

-Minister of Defense Marina Pendeš and her deputies Sead Jusić and Boris Jerinić, contrary to the Law on Service in the Armed Forces of Bosnia and Herzegovina and other relevant regulations, ordered and allowed the use and participation of part of the BiH Armed Forces on January 9, 2017, at a ceremony in Banja Luka, organized by the government of the entity Republika Srpska, marking January 9 as the day of the RS entity, which the Constitutional Court of Bosnia and Herzegovina, by Decision number U – 3/13 of November 26, 2016, determined to be unconstitutional.

It is important to emphasize that Marina Pendeš, Sead Jusić and Boris Jerinić exceeded the limits of their official authority when, contrary to the Law on Defense of BiH and the Law on Service in the BiH Armed Forces, they ordered and allowed the use of part of the BiH Armed Forces at the request of one member of the Presidency of BiH.

Thus, these officials allowed the illegal use of BiH Armed Forces units and failed to perform their official duty, according to which they can only allow the use of the BiH Armed Forces upon authorization from the Presidency of BiH.

Marina Pendeš, Sead Jusić and Boris Jerinić, through their (in)action, caused enormous damage to the reputation of BiH institutions, especially the BiH Armed Forces, for whose lawful operation they are responsible. They ignored the Decision of the Constitutional Court of Bosnia and Herzegovina, which is binding on all, and acted contrary to that decision. Considering Bosnia and Herzegovina's aspirations towards Euro-Atlantic integration, it is evident that Minister of Defense Marina Pendeš, as well as her deputies Sead Jusić and Boris Jerinić, have lost the credibility necessary to perform such responsible functions.

Due to all the above, we believe that Marina Pendeš, Sead Jusić and Boris Jerinić should no longer hold the positions they currently occupy, because with each day they spend in their functions, they cause even more damage to the reputation of the Armed Forces of Bosnia and Herzegovina. Therefore, it is necessary, as soon as possible and in accordance with the Rules of Procedure of the House of Representatives of the Parliamentary Assembly of BiH, to include on the agenda of the House of Representatives of the PSBiH a vote on the need for reconstruction of the Council of Ministers, the request of the state representatives of the SDP and DF states.
