Deciding on the proposal of the Prosecutor's Office of Bosnia and Herzegovina for detention, the Court of Bosnia and Herzegovina, on January 12, 2016, issued a decision by which the proposal was accepted, and a one-month detention was ordered for the suspects Bakir Dautbašić and Bilsena Šahman. Detention under this decision can last until February 11, 2016, or until a new decision by the Court.
Having reviewed the submitted evidence, the Court determined that there is a well-founded suspicion that the suspects have committed the criminal offense they are charged with, and ordered their detention due to the existence of a well-founded fear that the suspects, if at liberty, will destroy, hide, alter, or forge evidence or traces important for the criminal proceedings, as well as particular circumstances indicating that they will obstruct the criminal proceedings by influencing witnesses or accomplices, and the existence of particular circumstances justifying the fear that they will repeat the criminal offense.
Bakir Dautbašić and Bilsena Šahman are suspected of committing the criminal offense of obstructing the work of justice under Article 241 of the Criminal Code of Bosnia and Herzegovina.
