Court Decision: Brend Company Must Remove Guards and Allow Employees Entry

SARAJEVO, (Patria) – The Municipal Court in Sarajevo today issued a decision establishing a temporary measure ordering the company Brend d.o.o. to remove security guards from the Agency for the Protection of People and Property Gama AA from in front of the business building of the company Poslovnost.

The decision of judge Pavle Crnogorac states that the security guards pose a danger to the safety of the employees of the Poslovnost Agency and that the company Brend d.o.o. must refrain from harassing the plaintiff (Poslovnost) regarding the right of management and employees to enter the business building unhindered.

This measure will be submitted to the Enforcement Department for compulsory enforcement.

"This security measure lasts until the conclusion of the relevant dispute in this legal matter," the decision states. 

Eighty employees of the accounting firm Poslovnost have been unable to access their workplaces since September 2nd and cannot fulfill their obligations to 800 clients due to physical obstruction of access to the building where the company is located. 

In front of the concrete blocks placed in front of the Poslovnost building, employees gathered last Friday, as well as on Sunday with their families. Among the employees are a large number of families of martyrs, demobilized soldiers, and persons with disabilities. 

The concrete blocks were placed by the company Brend d.o.o. due to an property-legal dispute pending before the Municipal Court. Although the dispute has not yet been resolved, Brend acted arbitrarily and blocked the passage for the employees of the Poslovnost Agency. A security company was also engaged, preventing the movement of Poslovnost employees. 

The Poslovnost Agency points out that for more than 25 years, it has been contributing to the budget of the same institutions that now refuse to protect its business. 

"A company that fills the budget with over 100,000 marks every month through taxes and contributions. A company that has never been late in paying salaries to its employees, nor does it have a single convertible mark in debt for contributions to its employees. Every day of work obstruction causes immeasurable damage to the business," the company states. 

Solely due to the obligations they have to clients and the documentation they need, employees have been entering the company in the past few days using portable stairs from the Miljacka riverbank, endangering their lives.
