CEC's Decision to Revoke Milorad Dodik's Mandate: SNSD Presidency Unquestioned

(Patria) - The Decision of the Central Election Commission of Bosnia and Herzegovina, which revoked the mandate of Republika Srpska President Milorad Dodik, does not mention his position as SNSD President, which he continues to legally hold, writes Istraga.ba. Below is the explanation of the CEC's Decision to revoke Dodik's mandate as entity president.

“The content of the act from the Court of Bosnia and Herzegovina, submitted to the Central Election Commission of Bosnia and Herzegovina from the relevant verdict, also includes a note that the legal consequences of the conviction prescribed by Article 203a, paragraph 5 of the Criminal Code of Bosnia and Herzegovina, namely a) termination of official duty and termination of employment; c) prohibition of holding official duty in legislative, executive, judicial, administrative, or any body that is fully or partially financed from public funds; and d) prohibition of acquiring official duty in legislative, executive, judicial, administrative, or any body that is fully or partially financed from public funds, take effect by force of law, upon the finality of the verdict, which means that, given that the verdict in question became final on June 12, 2025, the accused Milorad Dodik cannot perform any of the duties or jobs listed in points a), c), and d) of Article 203a, paragraph 5 of the Criminal Code of Bosnia and Herzegovina,” states the CEC’s explanation.




The CEC further states that Article 1.10, paragraph (1), point 4 of the Election Law of BiH stipulates that the mandate of an elected official in any level of government ceases before the expiration of the term for which they were elected, on the date the court verdict sentencing them to imprisonment of six months or more becomes final.

“Furthermore, points 5 and 6 of the same paragraph of Article 1.10 stipulate that the mandate of an elected official in any level of government ceases before the expiration of the term for which they were elected on the date the court verdict imposing a security measure prohibiting the performance of a specific profession, activity, or duty that constitutes the function of an elected official in a government body becomes final, or on the date the court verdict imposing a sentence that has the legal consequence of termination of that official duty and employment relationship becomes final,” it is stated.

Additionally, the CEC emphasizes that paragraph (2) of the same article stipulates that the CEC shall issue a decision on the termination of the mandate of an elected official within a period not exceeding 15 days from the date the reasons for termination of the mandate occurred, or from the date of becoming aware of the reason for termination of the mandate, and shall inform the government body in which the elected official held the mandate.

Dodik has the right to appeal the CEC's decision to the Appellate Division of the Court of Bosnia and Herzegovina within two days of receiving the CEC's decision.
