
(Patria) - The Supervisory Board of the University Clinical Center of Sarajevo was appointed illegally, the Cantonal Court in Sarajevo has determined, Istraga.ba has learned. Consequently, the Government of the Federation of Bosnia and Herzegovina and Prime Minister Nermin Nikšić have been ordered to return everything to its previous state, i.e., to the state before the Decision on the dismissal of the former Supervisory Board of KCUS on October 4th of this year.
We remind you that on October 4th of this year, the Government of FBiH, at the proposal of the Prime Minister of FBiH Nermin Nikšić, dismissed the members of the Management and Supervisory Boards of KCUS, which effectively paved the way for the dismissal of the then director of KCUS, Sebija Izetbegović. The decision on dismissal was appealed by the then member of the Supervisory Board, Izmir Hadžiavdić. On December 28th, the Cantonal Court in Sarajevo stated that the Government of FBiH and Prime Minister Nermin Nikšić "committed a violation of the applicant's right to equality before the law, guaranteed by the Constitution of FBiH," writes Istraga.ba.
"The Government of FBiH and the Prime Minister of the Government of FBiH are prohibited from further carrying out illegal actions that restrict the rights of the applicant. The Government of FBiH and the Prime Minister are ordered to take the necessary measures to establish a legal state in relation to the applicant, as it was before the Decision of October 4, 2023, within 15 days. If the order is not complied with within the given deadline, the Court will file a request for the removal from duty of the official, the Prime Minister of FBiH, and if necessary, impose a monetary penalty," it is stated in the Decision of the Cantonal Court in Sarajevo.
No appeal is allowed against this decision of the Cantonal Court in Sarajevo, which means that this decision is final and enforceable.
Let us remind you that after the dismissal of the Supervisory and Management Boards of KCUS, the new Management and Supervisory Boards dismissed the then director Sebija Izetbegović. After that, a competition was announced for the appointment of a new general director, and on Thursday, the day of the Cantonal Court's decision in Sarajevo, the new Management and Supervisory Boards, which were illegally appointed, appointed Ismet Gavrankapetanović as the general director of KCUS.
