Conclusions on insufficient representation of Bosniaks in BiH institutions rejected

(Patria) - The 26th emergency session of the House of Representatives of the Parliamentary Assembly (PA) of Bosnia and Herzegovina was held in Sarajevo today.

Due to the lack of an entity majority, the request for urgent consideration of the Bill on Amendments to the Law on the State Investigation and Protection Agency (SIPA), proposed by MPs Jasmin Emrić, Ermina Salkičević-Dizdarević, Elvisa Hodžić, Šemsudin Mehmedović, and Aida Baručija, was sent to the Collegium of the House for harmonization.

The House of Representatives considered data on the ethnic representation of employees in the institutions of Bosnia and Herzegovina - the causes and consequences of the non-implementation of the Constitution and laws of BiH, which establish proportional representation of constituent peoples and others in BiH institutions, submitted by MPs Jasmin Emrić, Ermina Salkičević-Dizdarević, Elvisa Hodžić, Šemsudin Mehmedović, and Aida Baručija.

In relation to this data, a proposal for conclusions by MP Jasmin Imamović was sent to the Collegium of the House for harmonization, due to the lack of an entity majority. The conclusions state:

1. The Collegium of the House of Representatives of the PA BiH is tasked with submitting this data and the transcript of this session to the BiH Prosecutor's Office;

2. The House of Representatives of the PA BiH requests the BiH Civil Service Agency to urgently establish a Register of Employees, without waiting for the legally prescribed deadline, as stipulated by the Law on Civil Service in BiH Institutions, and to publicly publish the names and surnames of employees, omitting data that cannot be publicly disclosed (e.g., personal identification number), so that state bodies and citizens can take this into account, respecting the principle of transparency.

A proposal for conclusions by MP Nihad Omerović was also sent to the Collegium of the House for harmonization, due to the lack of an entity majority. The conclusions state:

1. The head of the Civil Service Agency is instructed, when forming competition commissions, to monitor the national structure of the commission members in accordance with the BiH Constitution and BiH laws, which establish proportional representation of constituent peoples and others in BiH institutions, and for the composition of competition commissions to reflect the percentage ratio of the national structure according to the last census, in order to improve the extremely unfavorable ratio, i.e., the deficit in the representation of employed Bosniaks, in the shortest possible time;

2. Strict implementation of this model for filling competition commissions must be carried out when forming competition commissions for management positions within all state institutions;

3. The Civil Service Agency is instructed, when filling vacant positions, to strictly monitor the national structure in accordance with the BiH Constitution and BiH laws, which establish proportional representation of constituent peoples and others in BiH institutions.

The House of Representatives of the PA BiH gave consent for the ratification of the Financing Agreement for the Annual Action Plan for Bosnia and Herzegovina for 2024 between the European Union, represented by the European Commission, and Bosnia and Herzegovina, represented by the Directorate for European Integration of the Council of Ministers of Bosnia and Herzegovina.
