DF's New Appeal: FBiH Government Was Unconstitutional Since Bajrović's Departure, Lacked Bosniaks in Composition!

The Democratic Front, led by Željko Komšić, reacted today to media reports that the FBiH Government's Decree on the Management of Enterprises was declared unconstitutional, and we remind you that the appellant was Milan Dunović (DF), Vice President of the FBiH, reports the Patria News Agency.

Komšić, addressing the media, stated that DF does not claim the decision is such, but refers to the media that published this information.

- Whatever and however it may be, in my opinion, this could only have happened, because it was clear to everyone from the very beginning, no matter what anyone says, because the Constitution and laws are clear and left no room for doubt. It is clear to us that this Decree is not in accordance with the law, but after all, you remember the farce with the failed attempt to change the Law on Electricity where the approval sent to the Parliament stated that the Law was being changed due to the need to align it with the Decree. I mean, it's the most ordinary legal circus, and then it was changed in the end.

The second thing I want to point out is that whatever the Constitutional Court decided is too late and means nothing. All the negative consequences that could have been avoided due to such actions were lost the moment the Constitutional Court refused to issue a temporary measure and halt the implementation of that Decree until a final decision was made – Komšić emphasized.

He further stated that everything was already done then, and a series of illegal moves followed.

- It is indicative that such behavior continues in the following days. In our country, unfortunately, politics is based on arrogance and force, not on respect for order and law. Everything they do could have been done through the regular procedure, but they don't want to, because they show arrogance and insolence – Komšić added.

Explaining what will happen, Komšić said that this decision of the Constitutional Court of the FBiH means nothing to DF as a party, just as it means nothing to the country, because it is too late.

- It cannot be done like that, no matter how many hands one has in the parliaments. I am now taking the opportunity to announce that we will again file an appeal with the Constitutional Court of the FBiH, which will seek that all actions of the FBiH Government, from the moment Reuf Bajrović was dismissed from the position of Minister of Energy until the moment a new one was appointed, are unconstitutional and that all decisions made by the Government violate the Constitution because the constitutional provision – the representation of constituent peoples – was not ensured during that period – Komšić stated.

He further explained that during that period, the FBiH Government did not have a sufficient number of Bosniaks in its composition.

- The FBiH Constitution is decisive. When talking about the structure of the FBiH Government, it states that it is composed according to the principle of 8-5-3, eight Bosniaks, five Croats, and three Serbs, with the possibility of one seat being taken from the most numerous constituent people and given to others, which was done, but then from those seven Bosniak seats, Čavara (Marinko Čavara, President of the FBiH, editor's note) decided to remove another Bosniak, by dismissing only Bajrović. Thus, the Government operated with six Bosniaks, which is absolutely contrary to the FBiH Constitution – Komšić added.

This appeal will be filed by Milan Dunović, Vice President of the FBiH, and it will be sought that all decisions made during that period be declared unconstitutional.
