NIP: State property can only be registered to the state of BiH

(Patria) - The issue of state property is one of the most important issues in Bosnia and Herzegovina after the signing of the Dayton Peace Agreement. The aktualization of this issue is an opportunity to reiterate the key principles on which the issue of state property can be resolved.

The fundamental principle and red line that must not be crossed is that the state of Bosnia and Herzegovina is the sole titular, i.e., owner of all state property, it was announced today from NIP, after SDA and SDP BiH issued statements yesterday.

NIP states that it is important to precisely define what constitutes state property.

"State property, among other things, includes: Immovable property belonging to the state of Bosnia and Herzegovina based on the international Succession Agreement; immovable property that the former Socialist Republic of Bosnia and Herzegovina had the right to dispose of and manage until December 31, 1991; agricultural land for which the Constitutional Court of Bosnia and Herzegovina has determined to be state property in its decision in case no. U-8/19, and rivers, forests, and forest land, for which the Constitutional Court of BiH has determined to be state property in its decisions in cases no. U-9/19 and no. U-4/21. State property can only be registered in the land registry to the state of BiH.

Only the Parliamentary Assembly of BiH, not the entities, can pass a Law on the management, use, or disposal of state property.

The issue of state property has largely already been resolved by the provisions of the Constitution of Bosnia and Herzegovina, which has been confirmed by the Constitutional Court of BiH on several occasions. The disposal of state property, the manner of use of state property requires a serious and systematic solution that will be based on the previously listed principles," it was announced.

Narod i Pravda has clearly communicated these principles on several occasions, and by initiating appeals to the Constitutional Court of BiH, which were accepted, we have shown a responsible and serious approach to this strategic issue. We believe that all pro-state parties have a clear stance on the issue of state property that transcends party frameworks. In this regard, we welcome the cooperation of all pro-state forces and the involvement of all relevant actors in resolving this issue.
