Nikšić Following Dodik's Footsteps for Čović's Interests: With the Draft Law on Construction Land, He Attacked State Property

While some of the key actors of the Trojka project are filing appeals to the Constitutional Court of BiH due to decisions of the imposed Federation Government, Nermin Nikšić and his crew are preparing to drive the final nail into the coffin of the state of Bosnia and Herzegovina through a draft law on construction land.

We recall, as the Istraga portal published today, Kemal Ademović, Chairman of the House of Peoples of the Parliamentary Assembly of BiH and Deputy President of the People and Justice party, filed an appeal due to the decision of the FBiH Government, which, contrary to the Law on Prohibition of Disposal of State Property, enabled the British company Adriatic Metals to change the purpose of forest land in the Vareš area.

A few days ago, specifically on March 10, 2024, the following information was published:

"The Government of the Federation of BiH today, at the proposal of the Federal Administration for Geodetic and Property-Legal Affairs (FGU), adopted the Draft Law on Construction Land in the Federation of BiH, which will be forwarded to the Parliament of the Federation of BiH."

And it is interesting that no one in charge reacted, even though the news itself states:

"It regulates the acquisition and protection of rights to construction land, as well as the termination of public property status and the regulation of construction land. It prescribes fees payable when using construction land, defines the rights and obligations of local self-government units and owners towards each other regarding planned construction and the permanent allocation of construction land…"

The draft law came from the FGU, headed by Željko Obradović. And Obradović is one of those budget moths who have lasted for years, living off the budget and loyalty to some political godfather. Obradović's godfather is Dragan Čović, who continuously keeps him in his position at the FGU. It should be noted that Obradović was a minister in HZHB, and that he is among the founders of the Geodetic Society of HZHB, from where he came to head the FGU.

Article 4 of the Draft Law on Construction Land

Article 4 of the Draft Law states: "Construction land is disposed of by its owners, under the conditions and with the limitations determined by this law and other applicable regulations. (2) Construction land that is recorded in the land registry as social, state property, public property or treasury without a registered right of use of another person, if by force of law it has not become the property of another person, after the entry into force of this law shall be registered as the property of the municipality, the municipality within the city of Sarajevo or the city (hereinafter: local self-government unit) in whose territory it is located, in accordance with the provisions of the Law on Property Rights ("Official Gazette of the Federation of BiH", No. 66/13 and 100/13), unless otherwise regulated by a special law."

Previously, the Law on Construction Land stated: "Urban construction land can be in state and private ownership."



Therefore, in addition to changing the purpose of land for the needs of the British company, Nermin Nikšić and the FBiH Government he heads have decided to enable the tycoonization of state land. Because this process cannot be viewed any other way.

Thus, the imposed Prime Minister Nermin Nikšić, otherwise on good terms with Čović's Obradović, sees nothing wrong with the fact that the new law on construction land would lead to the irreversible loss of state property.

Therefore, I will repeat once again that Nikšić's remark that one should not bother with "the story about some fields there" is actually a complete reflection of his attitude towards state property as a crucial issue for the survival of Bosnia and Herzegovina.

Admittedly, this immature and unstatesmanlike attitude is also rooted in the fact that the SDP BiH itself has seized this state property.

Since he started frequently associating with Milorad Dodik again, Nikšić has become increasingly inclined to act against the interests of Bosnia and Herzegovina. There are many examples, and state property is perhaps the crucial one. The acrobatics he performed with the forest in Vareš is just a drop in the ocean of possibilities for dispossessing the state of its property if the Draft Law on Construction Land is adopted.

And when it is left without property, i.e., territory as one of the conditions, the state of Bosnia and Herzegovina will be just a shell waiting for a breeze to blow it into oblivion.

To prevent this from happening, an appeal must be made to the reason of parliamentarians in the Federation to prevent the adoption of the law by which Nikšić and Obradović want to dispossess the state in favor of tycoons and lobbies.

The law is already in the Parliament of the Federation, and there is no doubt that the Trojka project, Nikšić and the HDZ will try to use the smoke screen of European integration to push through a law that distances us from the survival of the state.
