Nikšić on the decision of the Constitutional Court of BiH: Some think a hopeless thicket is better than a promising investment

(Patria) - "With the decision on the temporary measure, the Constitutional Court has temporarily suspended the contested decision of the Government of the Federation of BiH until the Constitutional Court makes a final decision in this case", it is stated in the announcement published on the website of the Constitutional Court of BiH, which was shared by the Prime Minister of FBiH Nermin Nikšić on his FB page.

"We have not yet received the decision to comment on it. Nevertheless, I want to clearly state that the Government of the Federation is the last one to even think about not respecting court decisions. Therefore, we will undoubtedly respect the decision on the temporary measure on our part, pending the final decision. Due to the nature of the contested decision, a temporary measure is logical so that no disproportionate damage occurs to investors until a final decision is made. Why for investors? Simply because damage occurs to the local community if there is no investment. To be completely clear, the Government's decision did not change the land titleholder; it remains state-owned, but in accordance with the proclaimed position of the Legal Counsel's Office, we allowed the possibility of temporary use until the concession agreement expires. After the termination of the agreement, the investor is obliged to return the land to its original state. Of course, it would be foolish to leave it as a thicket; it would be more logical to plant trees.

In the end, we will undoubtedly respect every decision of the Constitutional Court with the sincere hope that it will be sensitive to the needs of a local community that, after the decision to grant temporary use of the land, embarked on a path of development, and from a place without any prospects, from which residents left with a one-way ticket, became a desirable place to live.

Of course, it can be the other way around, that due to our bickering, egos, and false concern for the state, we kill all hope for these people and tell investors to run away from us and our foolishness. And perhaps we in the Government are truly wrong, when we thought we were doing good for Vareš and its residents. Some obviously think it is better to leave it as a hopeless thicket called state-owned, than a promising investment on land that is also state-owned", stated Nikšić.
