Nešić on Konaković's proposal: Do not interfere with police operational work, why does he object to Sky data received by RS MUP?

(Patria) - Regarding the proposal by Minister of Foreign Affairs Elmedin Konaković to include a provision in the Police Cooperation Agreement between BiH and the Republic of Serbia stating that 'entity and cantonal MUPs cannot conduct activities with the signatory country on BiH territory without the consent of the Directorate for Coordination of Police Bodies, OSA, SIPA', BiH Minister of Security Nenad Nešić says he wants to attribute Konaković's statement to the heat rather than ignorance or bad intentions.

"I do not want to believe that the Minister of Foreign Affairs Elmedin Konaković does not know how international agreements are concluded and amended, and that he has not read the Law on the Conclusion and Execution of International Agreements. In particular, I do not want to believe that the Minister of Foreign Affairs does not know the constitutional order of this country and that he does not know that entity and cantonal MUPs are independent administrative organizations that are not subordinate to DKPT, OBA, or SIPA. All police agencies in BiH, in accordance with the constitutional order, are completely equal, and no one should interfere with their operational work. No one should obstruct them. No law in this country gives the competence to BiH police and intelligence institutions to interfere with the operational work of entity and cantonal MUPs and to give them consent for activities within their jurisdiction," Nešić explained.

Minister Nešić adds that it is becoming very symptomatic that first an attempt was made to hinder the cooperation of the Ministry of Internal Affairs of Republika Srpska with Europol, all with the aim of gaining insight into the information that the RS MUP receives from Europol, and now Konaković is asking for police agencies at the BiH level, as well as OBA, to have insight into the operational actions of entity and cantonal MUPs.

"I get the impression that they would want to have data for every investigation, at the place where they can get information about who is being investigated for organized crime and what evidence has been collected. It bothered them that the Ministry of Internal Affairs of Republika Srpska directly receives information about the Sky application from Europol. Now it seems to bother them that undercover investigators and data from regional police forces can be used without them being able to easily find out about it," Nešić observes.

The correspondence from the Sky application, he points out, showed that criminal groups involved in narcotics are trying to infiltrate their informants into all police agencies, and most of all into those at the BiH level.

"That is something that should concern Konaković, not the fight against dangerous criminal groups. Therefore, it is great news that entity and cantonal MUPs conduct investigations independently and use the assistance of police forces from the region. What Konaković proposes is not only unconstitutional but also very risky due to the increased possibility of information leaks. Therefore, colleague Konaković needs to clearly state – is our opponent the police that works to dismantle organized crime and protect our children, or are our opponents organized criminal gangs that smuggle narcotics and launder money here!?" Nešić stated.
