Muriz Memić Writes to HJPC Again: My Doubts About the Work of the Disciplinary Prosecutor Are Justified

SARAJEVO, (Patria) - The father of the murdered young man Dženan Memić, Muriz Memić, has again sent a letter to the High Judicial and Prosecutorial Council (HJPC) stating that his doubts about the work of the Office of the Disciplinary Prosecutor (ODP) were justified, and that nothing has been done to date regarding the complaints he filed against the Chief Prosecutor of the Sarajevo Canton Prosecutor's Office, Dalida Burzić.

At the end of June, Memić wrote to the HJPC expressing doubts about the objectivity of the work of the HJPC's disciplinary prosecutor in the case of his son's murder.

- We have information indicating a close and long-standing friendship between the Chief Prosecutor of the Sarajevo Canton, Dalida Burzić, and the Chief Disciplinary Prosecutor, Alena Kurspahić – Memić stated at the time.

In a second letter sent to the President of the HJPC, Milan Tegeltija, and all members of the HJPC, Memić states that he considers the response he received from the Office of the Disciplinary Prosecutor a „provocation and belittlement of the crime victim.“ He states that his patience and that of his family has limits, and that „everything has taken on the proportions of torture and inhuman treatment towards us.“

- It is evident that the Office of the Chief Disciplinary Prosecutor has not grasped the seriousness of the case and the obvious omissions in the work of the Sarajevo Canton Prosecutor's Office, as well as other bodies (FBiH Prosecutor's Office, Sarajevo Canton MUP, FMUP, etc.).

Memić demands urgent action from the Office of the Chief Disciplinary Prosecutor based on the facts he has previously stated. He reminds that the Chief Prosecutor Dalida Burzić and other prosecutors „intentionally led the investigation in the wrong direction,“ that Burzić gave statements about Dženan Memić's injuries before the medical expert did, that she provided incorrect data to the Sarajevo Canton Assembly regarding the number of prosecutors working on the Memić case, etc.

In his letter, he states that Burzić has committed multiple disciplinary violations, as have other prosecutors, but that the ODP has still done nothing about it. He also provided the HJPC members with the ODP's response, which he received on July 17, signed by the Deputy Chief Disciplinary Prosecutor, Mirza H. Omerović.

That response states that they cannot inform Memić about „the actions taken by the Office in the investigation due to their confidentiality.“

- The investigation will be completed within the legal deadline, and its duration will also depend on the duration of judicial proceedings and the procedure for determining the legality of the prosecutor's office's work, taking into account the available resources of the Office, as well as its business obligations – Omerović states.

The Dženan Memić case has long become a picture of the state of our judiciary, Memić writes, so I call upon you, for who knows how many times, as the father of an innocently murdered child, to do what you are paid for and thereby preserve both your own honor and the honor of the judiciary itself.
