Lukač evaluated, despite SIPA report, received confirmation of no criminal charges!

In seven days, a session of the Independent Board of the FBiH Parliament will be held where candidates for the director of the Federal Police Administration (FUP) will be interviewed, writes the Patria News Agency.

Sead Selman, president of the Independent Board, told Patria that at the session on November 4, criteria that are an integral part of the legal procedure were established, and that they had evaluated the candidates before the official interview.

- The invitation was sent for November 18, and that session will be long because we have many candidates. At the session on November 4, only one candidate was evaluated, because in the case of re-election, that candidate (Dragan Lukač, note) must be evaluated, while the others will be evaluated on November 18 – says Selman.

Otherwise, the current director of the FUP, Dragan Lukač, applied for the position, followed by Svevlad Hofman, advisor to the director of the BiH Border Police (GP), and Robert Perić, head of the South Field Office of the GP. Among the candidates are Ensad Korman, current deputy director of the FUP, Željko Ćorić, head of the Regional Office of the State Investigation and Protection Agency (SIPA) in Mostar, Mustafa Hujdurović, inspector in the FUP, Rasim Hadžić, inspector in the FUP, Fahrudin Bećirović, former commissioner of Zenica-Doboj Canton, and Marko Dominković, an employee of SIPA.

According to the Law on Internal Affairs of FBiH, Article 33 clearly states that "persons against whom criminal proceedings have been initiated or who have been sentenced to imprisonment for a criminal offense by a final verdict, except for criminal offenses against traffic safety, in accordance with the criminal legislation in Bosnia and Herzegovina, or who have been disciplined for serious breaches of official duty, also cannot be appointed to the position of director".

However, Selman confirmed that all candidates have duly submitted documentation regarding their clean criminal records and the absence of ongoing criminal proceedings. These confirmations were obtained by the candidates from prosecutor's offices, courts, and other judicial institutions, but it remains unclear how Dragan Lukač, against whom SIPA has filed a report with the KS Prosecutor's Office for an alleged criminal offense, meets these criteria.

Although lawyers have clarified for us that a report does not necessarily mean a criminal investigation, according to the response from the Cantonal Prosecutor's Office of Sarajevo, it is evident that something is being done.

- The Prosecutor's Office of Sarajevo Canton has received a report marked "confidential" from the State Investigation and Protection Agency - SIPA. Given that it is a file marked "confidential", we cannot provide any information to the public at this stage of the proceedings – the KS Prosecutor's Office told Patria.

SIPA investigators have allegedly determined illegal actions, specifically Lukač's abuse of position regarding the payment of compensation for accommodation and utility costs, to which, allegedly, according to legal regulations, they are not entitled.

SIPA accuses Dragan Lukač of not annulling an illegal decision, thereby allegedly acquiring property benefits and damaging the Federation of BiH for more than 10,000 KM.

Furthermore, SIPA has allegedly filed a report against Lukač for the criminal offense of erasing work experience, which is recorded in the PIO/MIO Sarajevo Fund, with the aim of preventing the implementation of the Law on Police Officers in the part concerning the termination of employment.
