KV SBiH files a report with the Office for the Fight against Corruption: Who enabled the payment of salary to Bojan Bošnjak while he was in custody?

(Patria) - The President of the Cantonal Council of the Party for Bosnia and Herzegovina, Almir Bečarević, filed a report with the Office for the Fight against Corruption of the Sarajevo Canton due to the payment of salary to Minister Bojan Bošnjak while he was in custody.

From KV SBiH, they state that Article 6, paragraph (7) of the LAW ON SALARIES AND COMPENSATIONS IN GOVERNMENT BODIES OF THE SARAJEVO CANTON stipulates, we quote:

Article 6. (Determination of basic salary)
(7) The full working hours of employees is 40 hours per week.
Article 6, paragraph (5) of the same law stipulates, we quote:
(5) The basic salary is calculated and expressed monthly for FULL WORKING HOURS, according to the position and corresponding salary grade.

As can be seen from the cited articles of the Law, the basic salary is calculated and expressed for FULL WORKING HOURS, which last 40 hours per week.

The holders of executive functions in accordance with the above-cited Law are the Prime Minister and members of the Government of the Sarajevo Canton.

"During the time spent in custody, Minister Bojan Bošnjak was paid a full salary, and the same was paid in the amount of approximately 10,500 KM for three months. This practice continued even after the named person was released from custody, although certain restrictive measures were imposed on him, which specified that Minister Bošnjak cannot enter the premises of the Ministry.

A logical question arises: in what way does the Ministry of Finance calculate and pay salaries to Mr. Bošnjak, even though they know that for the payment of the basic salary, full working hours of 40 hours per week are required. Since it is impossible to fulfill full working hours from custody or to fulfill working hours while having a ban on access to the Ministry's premises, it is not clear how the basis of 40 hours for salary calculation is then achieved.

Therefore, we publicly submit this report against the Ministry of Finance and the Ministry of Justice and Administration in the Government of the Sarajevo Canton, for the reason that these two ministries are designated and responsible for supervising the application of the Law and therefore bear full responsibility for salary payments.

We also submit a report against unknown employees from the Ministry "managed" by Minister Bošnjak, who obviously have the task of recording the 40 hours spent at the workplace of the named minister.

To be completely clear, it is not our intention to harm Minister Bošnjak, but to determine how it is possible that the named person is recorded as working full time and salaries are paid from taxpayers' money for the time spent in custody or at liberty, but without permitted access to the Ministry.

This is a unique case in legal practice and a case of obvious public corruption, and therefore we believe that the Office for Corruption has full jurisdiction to investigate the entire case. The amount paid so far indicates the criminal liability of everyone in the chain of these payments.

The current authorities claim to have sensitivity to cases of corruption, so here is an opportunity to see that sensitivity in practice, given that it concerns taxpayers' money. If we can no longer count on the political responsibility of the authorities and understanding of the economic, financial, social, and any other context in which the ordinary citizen of the Sarajevo Canton lives, can we count on the anti-corruption letter of the law (?)", they ask from KV SBiH.
