Circle 99 on the 'Kovačević' case: An embargo on democracy in a UN member and an aspirant for European integration

(Patria) - Circle 99 issued a statement regarding the second-instance judgment of the Grand Chamber of the European Court of Human Rights in the "Kovačević" case.

"Had a similar situation occurred regarding the legality of representation before the International Court of Justice (ICJ) in the revision proceedings in the case of 'Bosnia and Herzegovina v. Serbia and Montenegro', i.e., if the agent for representation had obtained legality outside the Presidency of BiH and positive legal regulations, as was done by the Grand Chamber of the European Court of Human Rights in the 'Kovačević' case and the acceptance of illegitimate representatives in the proceedings, the outcome of the former and likely the latter would have been clearly different.

Especially since the 'third self-proclaimed party', the High Representative, was undeniably in a conflict of interest, siding with the political option that wants to keep Bosnia and Herzegovina in hegemonic subordination to neighboring countries at all costs, and to make the impossible ethnopolitical system, a subordinate and dysfunctional state, a permanent condition.

Or, perhaps, to new attempts at further destruction, federalization with the final outcome of territorial division to neighboring countries.

The traces of legal violence and recognizable political handwriting in the proceedings before the ECtHR are most evident in the inadmissible eliminatory 'ad hominem' argumentation, directed at Slaven Kovačević as a person, and not at the merits themselves advocated by millions of disenfranchised citizens in their demands for equal and equitable political rights throughout the territory of BiH, both during candidacy and during the exercise of active voting rights in elections.

The argument that Kovačević does not possess victim status has no valid legal basis, neither in common sense nor in the standards of all previous judgments and cases of the same type."

"We reject with indignation all unfounded claims by the ECtHR that the long-time member of Circle 99, Slaven Kovačević, threatened anyone or intimidated anyone, which speaks volumes for those who resorted to such unlawful argumentation.

Circle 99 is the initiator of the principle of constitutional reform, not applicant Kovačević, so the ECtHR's argument that the legitimate goal of his application is to achieve constitutional changes is simply unsustainable.

Similarly, is it not the legitimate goal in the judgments 'Sejdić-Finci', 'Zornić', 'Pilav', 'Šlaku', and 'Pudarić' always been to initiate constitutional changes to eliminate discrimination in the Constitution of Bosnia and Herzegovina? In our opinion - it is.

It is necessary in the current circumstances to face the fact that this entire procedure, it must be said clearly, places an embargo on democracy in a member state of the United Nations and an aspirant for European integration and democratic standards," emphasize Circle 99.

They appeal to the entire public, the media, and especially state-building political entities to accept the dissenting opinion in the proceedings before the Grand Chamber of the ECtHR by Judge Faris Vehabović as the most important and reliable elaboration of this procedure.

Legal science, both domestically and abroad, will undoubtedly deal with this precedent for a long time to come.

We call on our public in the country to familiarize themselves with the original text of Judge Vehabović, instead of biased and manipulative interpretations. Citizens in the diaspora have the most important role in disseminating Judge Vehabović's dissenting opinion, especially in places of foreign influence and decision-making about the future of our country."

"However, this battle is currently and obviously lost. But the war for a modern democratic, European Bosnian state is not and cannot be. It will depend on our determination, persistence, and brave commitment to a new political system of equal citizens and free people.

Any retreat from the clear perspectives of a modern Bosnian state and a non-conflicting society must be sanctioned by democratic instruments," stated Circle 99 in their announcement.
