Kovačević: Serbia is most bothered by the Resolution stating it knew about the genocide but did nothing to prevent it

(Patria) - Advisor to the BiH Presidency member Željko Komšić, Prof. Dr. Slaven Kovačević spoke last night on Hayat television about the significance of the Resolution on the Genocide in Srebrenica for the present and future of BiH.

Kovačević says that first, we should define what resolutions of the General Assembly represent, because that is where the answer lies to the reactions and actions undertaken by Aleksandar Vučić and Milorad Dodik.

- A resolution is a political stance of the United Nations on a certain issue. This means that the General Assembly, which is the highest body of the UN, will adopt a political stance on the genocide in Srebrenica.

Regardless of how many countries will vote for it – and I believe a large number of countries will vote for it – or abstain, or possibly vote against, that political stance of the United Nations will apply to them as well. Therefore, it is a political stance of the United Nations on the genocide in Srebrenica.

It is evident that this is setting off certain alarms, although I don't understand why for Vučić, Dodik, Vulin, Dačić, and some others.

Why are they doing this when it comes to judicially established facts and when the resolution is included in the category of culture of remembrance, in order to prevent any potential future attempt of new genocides anywhere on the planet, I don't know – Kovačević points out.

In his opinion, what bothers Serbia the most, which is still actively denying the genocide, glorifying and hiding war criminals, is the part in the draft Resolution that calls on all UN member states to adhere to the judgments of the International Court of Justice, which explicitly states that the then Federal Republic of Yugoslavia, and present-day Serbia – although it knew about the planned crime of genocide, did nothing to prevent it, and that it was carried out by the military and police forces of the RS.

- I think that part of the Resolution and the call to the 2007 judgment of the International Court of Justice bothers them the most – says Kovačević.

He also touched upon the continuous claims of the President of the RS, Milorad Dodik, that he respects the Dayton Peace Agreement, although he constantly announces secession. Kovačević reminds that the Dayton Agreement is an international legal treaty, not a buffet.

- Dodik is consciously manipulating the public with a measured approach to this document and only talks about things that interest him. When he says that the RS signed all 11 annexes of the Dayton Agreement, he forgets that all 11 agreements were also signed by the Republic of BiH as a signatory in the hierarchy above the entities, which of course makes it superior to the entities, and which also has its legal continuity established by the Constitution here.

Furthermore, it should be recalled that Alija Izetbegović signed on behalf of the Republic of Bosnia and Herzegovina upon authorization from the Assembly of the RBiH, Krešimir Zubak signed on behalf of the Federation of BiH upon authorization from the Assembly of the FBiH, while the annexes for the RS, because indictments had already been filed against the entire military and civilian leadership of the RS at the time, were signed by the late Nikola Koljević, upon authorization from Slobodan Milošević – Kovačević added.
