(Patria) - BiH Minister of Foreign Affairs Elmedin Konaković filed a criminal complaint on Thursday morning against HDZ and SNSD officials due to the illegal opening of the border crossing in Gradiška.

On the same day, a few hours later, Konaković voted at the session of the Council of Ministers of BiH to include this illegally opened crossing in the international agreement between BiH and Croatia on border crossings.

Namely, the Council of Ministers of BiH this week initiated the procedure for "legalizing" the illegally opened Gradiška border crossing. Ministers from the Trojka parties also voted for this decision (Zukan Helez was not present, Konaković voted under his authorization as deputy chair).

Just 48 hours after the "temporary" opening of the Gradiška (Novi Most) border crossing by decisions of HDZ and SNSD officials, the Council of Ministers of BiH adopted the draft of the "agreement between the Republic of Croatia and Bosnia and Herzegovina on border crossings", which also includes the "Gornji Varoš-Gradiška Novi Most" border crossing.

This is, in fact, the crossing that was opened by the decision of the Deputy Minister of Security of BiH, Ivica Bošnjak, and without prior consent from the competent institutions (the Management Board of the Indirect Taxation Authority and the Council of Ministers of BiH).

This agreement, however, has not yet been signed because the final decision, in accordance with the Law on the Conclusion and Execution of International Treaties, must be made by the Presidency of BiH.

According to the documentation in the possession of Istraga, the negotiation teams of BiH determined the draft border agreement in Zagreb on April 23 this year. Article 1 states that "specific border crossings are determined on the common state border between the contracting parties".

"Border crossings for international road traffic of passengers and goods, which, in accordance with the relevant legislation of the contracting parties, are subject to inspection controls and supervision: Svilaj-Donji Svilaj, Stara Gradiška-Gradiška, Gornji Varoš-Gradiška Novi Most, Ličko Petrovo Selo-Izačić, Kamensko-Kamensko, Nova Sela-Bijača", it is stated in the draft agreement.

Therefore, the Council of Ministers of BiH unanimously gave its consent for the illegally opened border crossing to be part of the agreement with Croatia.

We remind you that Zijad Krnjić, a member of the Management Board of the ITA BiH, refused to vote for the decision that would create prerequisites for the opening of the Novi Most Gradiška border crossing, demanding that the Management Board of the ITA first adopt a decision on the settlement between Republika Srpska and the Federation of BiH, because Republika Srpska owes the Federation about 150 million marks in indirect tax revenue.

After that, the bridge at the old Gradiška crossing mysteriously collapsed, and on the same day, the Deputy Minister of Security of BiH, Ivica Bošnjak (HDZ), made a decision to open a "temporary border crossing" at Novi Most Gradiška.

On the same day, the Minister of Finance of BiH, Srđan Amidžić, opened the border crossing, and trucks began crossing it on the same day.

"The transfer of goods subject to inspection controls and excise duties is not permitted at temporary border crossings," it is stated in the Rulebook on the procedure for determining temporary border crossings, which was adopted by the Council of Ministers of BiH in February this year.

Therefore, most goods could not be transported across this border crossing. However, regardless of this, trucks with goods crossed into the territory of the Republic of Croatia (EU) and BiH, although it is unclear how customs controls were carried out, given that the Management Board of the ITA did not adopt a new systematization, and the existence of customs control at this "temporary" border crossing was not established.

- Products of plant and animal origin started crossing this border crossing around noon - said Radovan Đurić, head of the Gradiška customs post, to ATV on May 21.

We remind you that the Novi Most Gradiška border crossing is "temporarily open". According to the Rulebook, goods subject to inspection controls cannot be transported across temporary border crossings.

According to the Law on Veterinary Medicine of BiH and the Rulebook on the conditions for import and transport of live animals, raw materials, products and by-products of animal origin, such goods must undergo inspection control.

Therefore, such goods cannot be transported across a temporary border crossing.
