Komšić: Bias of international officials contrary to public policies and principles of the EU and USA

(Patria) - The Chairperson of the Presidency of Bosnia and Herzegovina Željko Komšić assessed the bias of certain international officials involved in the issue of limited amendments to the Constitution and the Election Law as completely incorrect.

"It is evident that engaged international officials deviate significantly from the public policies of the countries they represent.

First, the meaning of two letters from US Secretary of State Antony Blinken, which explicitly emphasize the need to implement limited amendments to the Constitution and the Election Law of BiH, has been completely degraded.

Instead of consistently respecting this recommendation, it is clear that international officials engaged in this matter have prioritized amendments to the Election Law, neglecting amendments to the BiH Constitution, while the judgments of the European Court of Human Rights primarily mandated amendments to the BiH Constitution.

Second, when international officials speak about implementing the judgments of the European Court of Human Rights and the Constitutional Court of BiH, they sideline the implementation of all judgments of the European Court of Human Rights (especially avoiding mentioning the judgment in the Zornić case) and emphasize the need to implement the judgments of the Constitutional Court of BiH.

The context of emphasizing the implementation of the Constitutional Court of BiH's judgments is completely wrong, as the judgment on Božo Ljubić's appeal has been implemented, while on the other hand, the only judgment not implemented is the one on my appeal, which related to the constitutionality of electing the president and vice-president of the FBiH and RS entities.

Therefore, the factual situation indicates that the HDZ's demands have no legal basis in either the judgments of international or domestic courts.

Given this fact, it is completely unclear on what basis engaged international officials continue to show bias towards the HDZ's demands, which contradict both the judgments of the European Court of Human Rights and the Constitutional Court of BiH.

Furthermore, among the engaged international officials, a particularly noticeable benevolent view is taken towards the HDZ's proposals that deepen ethnic divisions in BiH's electoral system, which is again in complete contradiction with the public policies of the EU and the USA, while on the other hand, there is no necessary level of understanding towards much more constructive proposals from pro-Bosnian parties, which are in line with the public policies of the EU and the USA, as well as with the judgments of the European Court of Human Rights and the Constitutional Court of BiH.

It is also noticeable that the more constructive the pro-Bosnian side shows itself to be and its readiness for dialogue, the greater the pressure from engaged international officials on the pro-Bosnian and civic side.

The side which, insulting its elementary intelligence, is offered to agree to the ethnic division of the state of Bosnia and Herzegovina through the deepening of ethnic divisions in the BiH electoral system, under the guise of cosmetic changes. Something for which 150,000 voters are FOR and a million voters are AGAINST cannot be introduced under pressure; such a solution would be unsustainable and a source of new problems.

At the same time, the HDZ enjoys a completely relaxed position, even though the solutions it advocates represent the twilight of democracy and civilization.

Nevertheless, whatever bias may be present among the engaged international officials, I believe that none of the representatives of the pro-Bosnian parties have the right to agree to the ethnic division of the state, which could have long-term consequences for its existence.

This was not agreed to even under the conditions of genocide and ethnic cleansing, nor under the conditions when negotiations were held while the aggressor was massacring our citizens and destroying our cities.

History will not forgive those who signed the capitulation and division of the state in peacetime, especially when it is known that this was not done even under the conditions when policies seeking to subjugate Bosnia and Herzegovina were carrying out extermination and destruction," Komšić stated.
