Komšić wrote to HJPC: Rule of law endangered in Memić and Dragičević cases

SARAJEVO, (Patria) - BiH Presidency member Željko Komšić sent a letter to the High Judicial and Prosecutorial Council (HJPC) regarding the cases of the murders of Dženan Memić and David Dragičević, after meeting in December with the fathers of the murdered youths, Muriz Memić and Davor Dragičević, and last Wednesday with their lawyer, Ifet Feraget.

Both cases are in the public spotlight, but the fight for truth has been ongoing for three years in the Memić case and almost a year in the Dragičević case. In both cases, a timely and quality investigation has been lacking. The fathers discussed this with Komšić.

The High Judicial and Prosecutorial Council is responsible for establishing an independent judiciary, and it is in this context that Komšić wrote to the members of the HJPC and its president, Milan Tegeltija.

Unofficially, Komšić requested a reaction from the HJPC in both these cases, given that the prosecutor's offices working on them have maximum authority, but the question of accountability arises. He also stated that the rule of law has been called into question, which has disturbed the entire public.

Komšić also emphasized that the position of the victims in these two cases has been further undermined by the conduct of the prosecutor's offices, and that special attention should be paid to ensuring an adequate position for the victims in the proceedings. This was also pointed out by the lawyer for the victim families, Ifet Feraget.

The case of Dženan Memić's murder was opened by the BiH Prosecutor's Office, while there is still no final prosecutorial decision in the case of David Dragičević's murder. Therefore, the statement by the Chairman of the BiH Presidency, Milorad Dodik, that "the transfer of the case to the BiH Prosecutor's Office is underway" is surprising. This is also one of the questions that the president of the HJPC, Milan Tegeltija, should answer.

The HJPC is also considering Komšić's letter today, and the public has been excluded from this part of the session.
