(Patria) - A new decision of the Constitutional Court of BiH establishing that the Concessions Commission has not executed the Constitutional Court's decision regarding the Buk Bijela case, i.e., to resolve the dispute between BiH and the entity of the RS, which on its own initiative concluded an interstate agreement with the Republic of Serbia, opens new questions in the political relations of the new coalition partners.

It did not take long for the old/new Minister of Foreign Trade and Economic Relations, Staša Košarac, who bears his share of responsibility, which will be determined by the Prosecutor's Office of BiH after the Constitutional Court of BiH submits the decision on non-execution of the Constitutional Court's decisions, to deny the Constitutional Court of BiH and its decisions, and shift competencies to the entity of the RS.

''The construction of the HPP 'Buk Bijela' is exclusively within the competence of the institutions of the Republika Srpska, because the subject concession property is entirely located on its territory, so BiH has no jurisdiction in this matter,'' emphasized Košarac, who will take the oath in a few days, committing to respect the Constitution of BiH and fully implement the General Framework Agreement for Peace in BiH, and to protect and advocate for human rights and freedoms, and to protect the interests and equality of all peoples and citizens.

The Concessions Commission, after several attempts and delays, was unable to perform the required task. The reason is very clear: the commission is not complete, as some of its members have retired, and ultimately it remained mono-ethnic - Serbian.

The persons responsible for the farce surrounding the filling of the BiH Concessions Commission, which was a political game to buy time, are SNSD members Zoran Tegeltija (Chairman of the Council of Ministers) and Staša Košarac (Minister of Foreign Trade and Economic Relations).

In an attempt to maneuver in February last year, Tegeltija, by appointing Milomir Amović as Chairman of the BiH Concessions Commission and Ante Matić as his deputy, tried to secure that the mono-national composition of the Commission, mostly coming from the RS, would make a decision favorable to the RS. Responsible for filling, i.e., proposing personnel for the Commission, is Staša Košarac, who did not do this job. And he did not do it, counting on the whole story eventually ending at the political table, i.e., in political trade. Both Tegeltija and Košarac have been proposed as ministers in the new Council of Ministers of BiH.

While the denial of the judgments of the Constitutional Court of BiH continues, along with the assault on state property, which can only be decided by the state and not by the entities, one of the coalition partners of the SNSD and the future head of BiH diplomacy believes that it is possible to function differently with the main denier of the state of BiH and its institutions, Milorad Dodik.

“We have seen in several examples that it is possible to function differently with Dodik, in a way - we will not block any projects in the RS, but they will have to respect the constitutional competence of the Parliament of BiH, the Concessions Commission, and some other bodies that give consent to this. We cannot allow not only the RS but also the Federation, municipalities, or cantons to take over the competencies of the state of BiH, implement and realize projects in such a way. On the other hand, we will very gladly support projects located in any part of BiH that bring economic or other interest to our country,” said Elmedin Konaković.

If the Council of Ministers of BiH is confirmed next week, this mandate will be marked by crises precisely on state issues. The SDP, NIP, Naša stranka (Zukan Helez, Konaković, Edin Forto), and the joint candidate of the SNSD and SDP (Sevlid Hurtić) will have a historic responsibility to protect the property of BiH, not to jeopardize the sovereignty of BiH through projects that would bring more profit to Serbia than to BiH.

The red lines that were not included in the signed agreement should be activated at the first session of the Council of Ministers of BiH, when the SNSD will deliver requests for projects in the RS that appropriate state property, which can only be decided on by the Parliament of BiH.
