Kešo: The "Trojka" must not facilitate Dodik's takeover of the BiH Concessions Commission

(Patria) - SDA MP in the BiH Parliament Safet Kešo addressed the public on social media today, stating that the "Trojka" must not facilitate Milorad Dodik's takeover of control over the BiH Concessions Commission.

"The tender procedure for the appointment of the new BiH Concessions Commission is nearing its end. Due to political obstructions and blockades, and operating under a technical mandate, the Commission's work results are practically non-existent. The Republika Srpska entity has on several occasions requested its abolition.

Nevertheless, this is a very important regulatory body at the state level, which, among other things, resolves disputes between entities and the state regarding state property. Hence, the blockades and requests from the Republika Srpska entity to abolish the Commission are clearer.

However, the tender for the election of seven new members has been announced, and it is highly likely that the authorities of the Republika Srpska entity, if they cannot abolish it, will try to bring this Commission under their control.

Some of the names competing for the election of three members from the Republika Srpska entity, three from the Federation of BiH entity, and one from Brčko District further fuel such suspicions.

The first decision that should be before the newly appointed Concessions Commission is the resolution of the dispute between BiH and the Republika Srpska entity regarding the construction of the Buk Bijela hydroelectric power plant.

As is known, the Constitutional Court of BiH, at the request of 24 MPs of the House of Representatives of the BiH Parliament, determined in mid-2021 that there are legal dilemmas regarding the concession award for this project, and ordered the BiH Concessions Commission to resolve the dispute within three months.

The dispute has not been resolved, the Commission has not made a decision, and the case, due to non-compliance with the decisions of the Constitutional Court of BiH, has ended up in the BiH Prosecutor's Office.

Therefore, the dispute will be resolved by the new Commission, appointed by the Council of Ministers of BiH and confirmed by a majority vote of the Parliamentary Assembly of BiH.

If Dodik controls the Commission, there is no doubt what decision will be made regarding the Buk Bijela hydroelectric power plant and what all future decisions concerning state property will be.

There should be no doubt about that, but what should certainly be doubted is the attitude of the "Trojka" towards this issue. There are sufficient grounds for suspicion that the "Trojka", with all its previous failures, will once again facilitate Dodik in this new endeavor against BiH. And be his accomplice.

Because, it should not be forgotten that in March this year, the imposed federal Prime Minister Nermin Nikšić, who is also the president of the SDP, stated that he had "reached an agreement with the Prime Minister of Republika Srpska Višković that the two electricity providers (EPBiH and EPRs) will each get a 25 percent share in this project, while 50 percent would go to the Republic of Serbia".

Thus, Nikšić, despite the decision of the Constitutional Court of BiH, knowing that the project is disputed, reached an agreement with the authorities of Republika Srpska. On whose behalf, who authorized him?

If such an agreement exists, and Nikšić himself says it does, then it is to be expected that the "Trojka" will, together with Dodik, select a BiH Concessions Commission that will fulfill agreements detrimental to BiH made by the two entity prime ministers and act according to Dodik's dictates, rather than considering the interests of the state.

Whether the "Trojka" is preparing for a new subservient bowing and a new betrayal will be known in the coming days. This time they are warned. They will not be able to say, as in the case of the disastrous Law on Residence, "that it was not considered that the Ministry of Internal Affairs of Republika Srpska would misuse that law".
