Candidates - Senior Civil Servants Required to Resign

Transparency International Bosnia and Herzegovina calls on senior civil servants who have applied for the 2014 General Elections to, in accordance with relevant civil service laws, submit resignations from their positions in the civil service.

TI BiH reminds that Article 16 of the Law on Civil Service in BiH, as well as relevant regulations at lower levels, stipulates that, in the event of confirmation of candidacy for a public office, a senior civil servant is obliged to resign from their position in the civil service. On the other hand, for other civil servants, it will be considered that the civil servant is on leave from the civil service from the moment their candidacy for a public office to which they are elected directly or indirectly is confirmed, or from the moment they are appointed to a position in any legislative or executive body, at any level of government in Bosnia and Herzegovina.

TI BiH also reminds that the Law on Civil Service in BiH provides for financial sanctions in the amount of 2,000 to 5,000 BAM for senior civil servants who do not submit a resignation from their position in the civil service after their candidacy has been confirmed.

TI BiH will therefore monitor in the coming period whether the aforementioned provisions of the civil service regulations are respected and report any deviations to the competent institutions, and appeals to candidates to whom these provisions apply to act in accordance with the law and submit resignations.
