Jeleč knows he must not speak: Jerinić nevertheless revealed the content of the confidential report on January 9

On Thursday, February 2, the report on the investigation conducted regarding the engagement of members of the Armed Forces of BiH on January 9 in Banja Luka, during the celebration of the unconstitutional holiday, was completed. This report should be presented to the members of the Presidency of BiH at a session on February 7, writes Patria.

While the Chief of the Joint Staff of the Armed Forces of BiH, General Anto Jeleč, who submitted the report to Defense Minister Marina Pendeš, and she then to her deputies, avoids discussing the content of this document because it bears the label CONFIDENTIAL, Deputy Minister Boris Jerinić, despite the fact that the content is classified, briefly recounted its content in a statement to the media.

-The Constitution, no law, no regulation was violated, and in the report itself there are no responsible persons nor those who will be punished, these are the details from the report presented to the public by Jerinić.

Thus, as a high state official, he violated the provisions of the Law on the Protection of Classified Data.

Article 19 of this Law defines that the label CONFIDENTIAL is assigned to data whose unauthorized disclosure would harm the security or interests of Bosnia and Herzegovina.

Article 11 defines the confidentiality of data. This article states that all officials who have legal authorization to access classified data are obliged to keep the data secret until the classification label is removed, regardless of how they obtained it, and this applies even after the expiration of their mandate, termination of employment, or cessation of their duties or membership in the relevant body.

As a reminder, three different reports arrived at the office of Minister Pendeš this week, prepared by members of the investigative commission formed by Jeleč on her order. One is Bosniak, another Serbian, and the third Croatian. The commission consisted of three Bosniaks, two Serbs, and one Croat.

It is questionable whether it was even necessary to form a commission given that there is a General Inspectorate of the Ministry of Defense of BiH headed by General Enes Husejnović, whose jurisdiction includes precisely such cases.

It is certainly indicative why General Inspector General Enes Husejnović, although obliged by law, did not immediately initiate an investigation himself, independently of the minister's decisions.
