The Only Ones Issuing Licenses in BiH: What is the Role of Andrić, Pejić and Others in the Monopoly of the Široki Brijeg School

Thousands of drivers from Bosnia and Herzegovina are demanding that the Council of Ministers of BiH abolish the monopoly of the Široki Brijeg school "Centar za obrazovanje", which is the only one in BiH that verifies diplomas for international transport, a story that still occupies the BiH public, writes Patria.

That illegal actions regarding the rulebook, public authorizations and payment of money for driver licenses occurred could be heard at one of the sessions of the BiH Parliament when MP Amir Fazlić posed a parliamentary question to the Deputy Minister of Transport and Communications Saša Dalipagić (HDZ) regarding this issue, and he claimed he did not hear well!?

However, our sources, who also provided us with all the documentation, claim that an organized group within the Ministry is responsible for the preparation and adoption (in 2011) of the Rulebook on conditions and procedures for issuing licenses and qualification cards for drivers performing international road transport.

- Everything was done deliberately and systematically, and those responsible are civil servants Zoran Andrić, Assistant Minister, and Igor Pejić, Acting Secretary, because they prepared it, and Minister Rudo Vidović, at the end of 2011, contrary to Article 5 and Article 47 of the Law on Road Transport, adopted the Rulebook.

The Rulebook regulates areas for which the minister is not authorized by law, nor are these areas regulated by law at all, which relates to driver qualification cards, publishing a public call for the selection of bodies that will conduct professional training for transport managers and drivers in international road transport, issuing approvals for performing professional training tasks for transport managers and drivers, entrusting (granting) public authorizations, adopting a price list for professional training and exams for transport managers and drivers in international road transport, and determining payment accounts – warns our source.

Furthermore, responsibility is reflected in the illegal publication of the Public Call for the selection of bodies that will conduct professional training for transport managers and drivers in international road transport, because the Ministry is not competent for the field of education, nor does the published public call refer to any legally prescribed possibility for selecting a body for entrusting public authorizations.

Responsibility also lies in issuing the Approval for performing professional training tasks for transport managers and drivers dated November 23, 2011, because this approval was issued (by Rudo Vidović, minister) contrary to the Law on Administration, and outside the Ministry's competence prescribed by Article 10 of the Law on Ministries and Other Administrative Bodies in BiH.

Then, in entrusting public authorization, because the Secondary Vocational School with Public Rights "Centar za obrazovanje" Široki Brijeg was entrusted with public authorization based on Article 17 of the Rulebook and the Approval, by signing the Contract on performing tasks of professional training for transport managers and drivers in international road transport number dated January 5, 2012, contrary to Article 5 and Article 47 of the Law, then Article 9 and 22 of the Law on Administration, and outside the Ministry's competence prescribed by Article 10 of the Law on Ministries and Other Administrative Bodies in BiH.

All this is stated in the opinion of Minister Bariša Čolak, and the document is in Patria's possession.

Responsibility is also related to the adoption of the Price List for professional training and exams for transport managers and drivers in international road transport dated January 31, 2012, and the proposal was made by Zoran Andrić, Assistant Minister, and Igor Pejić, Acting Secretary, and adopted by Rudo Vidović, minister.

Particularly questionable is the distribution of funds, because their actions are contrary to the Law on Administration, the Law on Administrative Fees, and the Law on Financing Institutions of BiH. This opinion was given by former Minister Nikola Špirić, at the request of Minister Damir Hadžić.

The method of revenue collection will also have to be uncovered, because the total financial resources (estimated at 3.5-4.0 million KM) were collected into the account of an institution with public authorization (Secondary Vocational School with Public Rights "Centar za obrazovanje" Široki Brijeg), and according to the Law on Administration, revenues of institutions with public authorization constitute Budget funds.
