Report by Kulić's commission is a plagiarism, who was paid 160,000 euros

After the Civil Aviation Directorate of BiH (BHDCA) conducted a complete and comprehensive analysis of the Report on the plane crash in which the President of Macedonia Boris Trajkovski died in 2004, by the Commission led by Mr. Omer Kulić, and in order to protect the dignity of the Civil Aviation Directorate of BiH and the Commission that conducted the investigation in 2004, BHDCA wishes to inform the public of BiH that the Final Report compiled by the Commission led by Mr. Kulić is a plagiarism of the "Final Report on the investigation of the accident of the Beechcraft Super King Air 200 aircraft, registration number Z3-BAB, Mostar of 26.02.2004", which was published on 05.05.2004, and the determined cause of the accident is exactly what the commission determined in 2004, and that a number of material and procedural omissions were made, both during the formation of the commission itself, and in its work, and the presentation of the Report, reports the Patria news agency.

Namely, the Final Report of the 2004 Commission stated that the cause of the accident was: "Procedural error in the approach for landing, in altitude and position, at Mostar airport in controlled flight (Controlled flight into terrain-CFIT)", while the Commission led by Mr. Omer Kulić presented the same, only in different words: "Descent below the minimum descent altitude (MDA) of 1810 feet, published for the non-precision approach procedure for landing at Mostar airport: 1.06 Mostar-LQMO, VOR/DME RWY 34 (Jeppesen 13-1), in controlled flight (Controlled Flight Into Terrain-CFIT)".

In addition to this fact, through the expert analysis of the Report of the Commission led by Mr. Kulić, BHDCA has determined a number of other omissions, both in the work of the Commission itself, and in the Report itself, as well as in its presentation to the public, both in BiH and in Macedonia. The Commission in question did not adhere to any standard listed in ICAO Annex 13, violated the provisions of Article 109, paragraph 2 of the Law on Aviation of BiH, and made a number of other procedural and material omissions.

As it is foreseen that new investigations into the causes of aircraft accidents are formed only and exclusively if new and significant evidence emerges, the expert services of BHDCA, analyzing the report of the commission led by Mr. Kulić, could not find any new and significant evidence or their examination anywhere. Based on this, the Commission led by Mr. Omer Kulić conducted a REVIEW of the "Final Report on the investigation of the accident of the Beechcraft Super King Air 200 aircraft, registration number Z3-BAB, Mostar, 26.02.2004", which was published on 05.05.2004, which is not foreseen by any international standard.

The plagiarized Final Report was compiled with one single goal, to discredit the Commission that previously conducted the investigation, whose results were literally copied in some places, and in others were simply stated in a different way and, as such, are found in 80% of the text of the new report. The key difference between the plagiarized Final Report and the Final Report, which was published on 05.05.2004, lies in the public disclosure of evidence and data by the "sensationalist commission", which is completely contrary to international standards and domestic regulations.

Based on the above, BHDCA concludes that both reports determined the same cause of the accident, and publicly poses the following questions:

1) Why was a new investigation opened?

2) Why did the investigation last an inappropriately long time (from 13.05.2013 to 29.11.2014)?

3) Why did this investigation cost 160,000 euros, as stated in the media by the chief investigator Mr. Omer Kulić?

4) Who paid or should pay the investigation costs and to whom was it paid?
