
(Patria) - The defendants in the case code-named "Trn", with evidence from decrypted SKY and Anom applications, after reviewing the prosecution's evidence, in the presence of their lawyers, signed plea agreements and fully admitted responsibility for the criminal offenses they are charged with in the indictment of the Prosecutor's Office of Bosnia and Herzegovina, after which they were convicted in the Court of Bosnia and Herzegovina.
In accordance with the agreements, the following sentences were proposed for the defendants: Nedeljko Lubura, born in 1975, at the time of the commission of the criminal offense employed by the RS MUP, a citizen of Bosnia and Herzegovina, a prison sentence of 2 years, and
Bojan Roguljić, born in 1981 in Banja Luka, a citizen of Bosnia and Herzegovina and the Republic of Serbia, a prison sentence of 1 year, as well as an additional fine in the amount of 10,000 KM, which the defendant is obliged to pay within 3 months from the finality of the judgment of the Court of Bosnia and Herzegovina.
Nedeljko Lubura was found guilty of the criminal offense of people smuggling under Article 189 of the Criminal Code of Bosnia and Herzegovina and abuse of official position or authority under Article 315 of the Criminal Code of the Republika Srpska, and defendant Bojan Roguljić was found guilty of the criminal offense of people smuggling under Article 189 of the Criminal Code of Bosnia and Herzegovina.
The defendants admitted guilt that, at the end of 2020, they illegally transported M.I., who was in Slovenia, across the state border into Bosnia and Herzegovina, knowing that an Interpol warrant had been issued for him at the request of law enforcement agencies in Montenegro, as a suspect for the criminal offense of attempted murder. The first defendant, at the time of the commission of the criminal offense, was a high-ranking inspector of the RS MUP, from which he was removed after the procedure conducted in that police agency.
The proposed sentence is adequate to the role and responsibility of the defendants in the commission of the criminal offense. By signing the agreement, the defendants waive their right to a trial and cannot appeal the criminal sanction.
After reviewing the agreements, they were accepted by the Court, and the aforementioned sentences were imposed on the defendants, and the case was finally concluded without a court proceeding and main trial.
This is the third plea agreement in cases with evidence from SKY and Anom applications. Within three cases, a total of fifteen defendants have so far pleaded guilty, two of whom are former members of police agencies.
