OHR stated what we already know: January 9th is unconstitutional and its commemoration is a criminal offense

(Patria) - The Office of the High Representative (OHR) warned today that commemorating January 9th as the day of Republika Srpska represents a disregard for the final and binding decisions of the Constitutional Court of BiH, emphasizing that such actions may also have criminal law consequences.

In a statement, the OHR reminded of the position of the Constitutional Court of BiH that the designation of January 9th as the day of Republika Srpska does not symbolize collective and shared remembrance in a multi-ethnic society, and that such practice is discriminatory.

They also state that the commemoration of this date represents a clear non-implementation of the decisions of the Constitutional Court of BiH, emphasizing that non-compliance with these decisions may constitute a criminal offense in accordance with the provisions of the Criminal Code of Bosnia and Herzegovina.

"Taking legally prescribed measures falls under the jurisdiction of law enforcement agencies, especially when it comes to public office holders," the OHR stated.

They also stated that the High Representative emphasized that respect for the rule of law, dialogue, conversation, and compromise are of key importance for any form of commemoration of the day of Republika Srpska to be inclusive and accepted by all citizens of BiH.

He also added that such an approach could contribute to strengthening social cohesion, instead of deepening existing divisions in society.
