IBRO BERILO AND OTHERS: Prosecutor's Office KS was on the verge of indictment, POSKOK took over the case and it is now in the 'investigation phase'!

Although an indictment in the "Bjelašnica" case was expected by the middle of this year, the transfer of the case from the KS Prosecutor's Office has slowed down the final outcome in this case.

KS Prosecutor's Office prosecutor Darko Soldat had prepared the indictment, but then a request arrived from the Special Department for Combating Corruption, Organized and Inter-Cantonal Crime of the Federal Prosecutor's Office of FBiH (POSKOK) to take over several cases, including this one.

Although the completed case was handed over to POSKOK and everything was ready for the indictment, POSKOK stated for the Impuls portal this week that the "case is in the investigation phase".

The first defendant is expected to be Ibro Berilo, and it was precisely because of his arrest and restraining orders that Berilo could not assume the duties of the Mayor of Trnovo municipality, even though he won the local elections in October 2024. Given that POSKOK has taken over the case, the Special Department for Corruption, Organized and Inter-Cantonal Crime of the Supreme Court of FBiH will now decide on further measures against Berilo, as well as other suspects in this case.

In addition to Berilo, the suspects are his assistant for geodetic and property-legal affairs Nađa Milišić, the founder of the company LOK-PIL d.o.o. Adis Mulaosmanović and his sister Edina Džigal, who own apartments in the Aroma building in Babin Do, former director of Sarajevo-šume Nermin Demirović, and former Minister of Communal Economy, Infrastructure, Construction, Spatial Planning and Environmental Protection in the KS Government Bojan Bošnjak. Bošnjak was arrested on November 15, 2023, and released from custody in February this year. Given that he was under restraining orders prohibiting him from performing his duties, as well as entering the KS Government, he was dismissed from his ministerial position in March 2025. Bošnjak was Naša stranka's nominee for this position.

As part of the investigation, Bošnjak's mobile phones and electronic devices, as well as those of his associates from the Ministry, were examined.

Bošnjak is suspected of giving a positive opinion on the strategic environmental impact assessment report, which his predecessors claimed was inconsistent with the law and refused to sign. Sources close to the investigation previously stated that this paved the way for the legalization of a series of controversial urban planning projects.

The president of Naša stranka, Edin Forto, was also linked to this case, allegedly asking Bošnjak to approve the Strategy.

The KS Government, while the case was handled by prosecutor Soldat, was asked to provide a transcript of the KS Government session at which this strategy was adopted. As prosecutor Soldat stated at one of the hearings, the KS Government obstructed the delivery of the requested material.

When it comes to taking over cases from cantonal prosecutor's offices, POSKOK already has almost 400 cases, handled by eight prosecutors, including the head of POSKOK, Hrvoje Čabrajić.

Since all POSKOK prosecutors are from the KS Prosecutor's Office, this prosecutor's office now has a shortage of 14 prosecutors. The HJPC should soon announce competitions for the vacant positions, and most of the cases transferred to POSKOK are precisely from the KS Prosecutor's Office.
