Will Nikšić wait for a new decision from the Constitutional Court of BiH or will he participate in the work of the BiH Fiscal Council with Minić?

(Patria) - The Council of Ministers of Bosnia and Herzegovina will not consider the Draft Law on the Budget of Institutions of Bosnia and Herzegovina and International Obligations of Bosnia and Herzegovina for 2026 until the Fiscal Council in BiH adopts the document Global Framework of Fiscal Balance and Policies in BiH for the period 2026 – 2028.

The Advisory Group of the Fiscal Council in BiH agreed on the text of the document Global Framework of Fiscal Balance and Policies in BiH for the period 2026 – 2028, at its 13th session held on January 5, 2026, and submitted it to the Fiscal Council in BiH for adoption.

However, due to the opposition of the Federal Prime Minister Nermin Nikšić, who wanted to wait for the decision of the Constitutional Court of BiH on the constitutionality of the RS Government headed by Savo Minić, as he was proposed by Milorad Dodik whose mandate as President of RS was revoked, the adoption of the Global Fiscal Balance did not happen.

In the meantime, the election of the new RS Government, again headed by Savo Minić, followed, and on January 26, a request was again submitted to the Constitutional Court of BiH to verify the legality of the appointment of that Government, as Minić was proposed by the acting President of RS Ana Trišić-Babić.

At this moment, it is not known whether Nikšić will again wait for the decision of the Constitutional Court of BiH or support the Global Framework of Fiscal Balance so that preparations for the adoption of the Budget of BiH Institutions and International Obligations for 2026 can begin.

The Fiscal Council consists of the Chairperson of the Council of Ministers of Bosnia and Herzegovina Borjana Krišto, the Prime Minister of Republika Srpska Savo Minić, the Prime Minister of the Federation of Bosnia and Herzegovina Nermin Nikšić, the Minister of Finance and Treasury of Bosnia and Herzegovina Srđan Amidžić, the Minister of Finance of Republika Srpska Zora Vidović, the Minister of Finance of the Federation of Bosnia and Herzegovina Toni Kraljević. Constituent peoples in Bosnia and Herzegovina must have at least one representative in the Fiscal Council.

For the session of the Fiscal Council to be held, at least five of its members must be present. For the decisions to be legally valid, at least five members of the Fiscal Council and at least one representative of each constituent people in Bosnia and Herzegovina must vote in favor. In other words, without Nikšić, no decision of the Fiscal Council can be adopted.
