Haznadar: Milan Tegeltija is the main culprit for my property not being returned

Due to the sluggishness of the BiH Prosecutor's Office, well-known Bosnian businessman Dževad Haznadar lost multi-million dollar property in Laktaši near Banja Luka.

In an interview for the BiH news agency Patria, Haznadar reveals that as early as 2013, he submitted irrefutable evidence to the Prosecutor's Office that the company H.I.G.A.T. from Banja Luka, owned by controversial businessman Milorad Mihajlović and one of the financiers of SNSD, illegally appropriated real estate worth almost three million KM from him, located near Laktaši, Banja Luka.

The Prosecutor's Office has never moved this case forward.

The BiH Prosecutor's Office ignored this case even at the insistence of the Ombudsman for Human Rights in BiH, who requested that this case be expedited.

Haznadar sees the reason why the BiH Prosecutor's Office does not want to deal with his case in the fact that Milan Tegeltija, President of the High Judicial and Prosecutorial Council of BiH, and then President of the Basic Court in Banja Luka, was directly involved in the process of seizing his property.

In addition, Haznadar recently offered evidence that the investigation should be extended to the Chief Disciplinary Prosecutor of BiH, Arben Murtezic, who, when Tegeltija was appointed head of the HJPC in 2014, concealed that a criminal complaint had been filed against Tegeltija with the BiH Prosecutor's Office for aiding and abetting multi-million dollar crime.

He recalls that Murtezic kept the request for initiating disciplinary proceedings against Tegeltija in his drawer for a year and a half, and then on July 7 last year, he stated that there were no elements for Tegeltija's disciplinary responsibility, after which Tegeltija was appointed president of the HJPC the next day.

- The judiciary in RS is a cancer on society, and the High Judicial and Prosecutorial Council of BiH helps them in illegal activities - says Haznadar.

- And, if we are to go further, specifically for my case, the BiH Prosecutor's Office also helped the RS judiciary to carry out multi-million dollar crime through its inaction - adds Haznadar.

He does not want to speculate much, but he says that all this leads him to believe that Tegeltija has a direct influence on the work of the BiH Prosecutor's Office, which is terrifying.

He says that from the example of his case alone, it is clear that the judiciary in RS acts arbitrarily.

- The Constitutional Court of BiH ordered that the execution procedure for the confiscation of my property be annulled, which was also confirmed by the District Court in Banja Luka. Unfortunately, the Basic Court, at that time headed by Tegeltija and judge Pejović, ignored the decisions of higher instances - says Haznadar. 

The company H.I.G.A.T. owned by Milorad Mihajlović sued Haznadar's company "Domet" in 1992 for a non-existent debt, and the lawsuit was filed based on falsified agreements on the jurisdiction of arbitration before the Arbitration Court in Belgrade.

Based on that arbitration award, the Basic Court in Banja Luka - in the execution procedure, allowed H.I.G.A.T. to take ownership of Haznadar's property.

For more than 23 years, Haznadar has been trying to prove that this was a major fraud in which valuable real estate near Laktaši, estimated at nearly three million KM, was illegally taken from him. He has offered volumes of irrefutable evidence, expert opinions that revealed forged documents, but none of it helped him get his property back.

Due to this case, Haznadar filed a criminal complaint against the owner of the company H.I.G.A.T., Milorad Mihajlović, and his wife Slobodanka, Nebojša Pejović, judge of the Basic Court in Banja Luka, Dragan Macanović, assistant director of the Republican Administration for Geodetic and Property-Legal Affairs, as well as the then director of this institution, Tihomir Gligorić, and Milan Tegeltija, then president of the Basic Court in Banja Luka, and now president of the HJPC.

However, this case never received a court epilogue, and Haznadar never got his property back.

Interestingly, the owner of the company H.I.G.A.T., Milorad Mihajlović, was one of the main associates of The Hague indictee for war crimes in BiH, Radovan Karadžić, during the aggression against BiH, and in recent years he has also been mentioned as one of the main partners of SNSD.

The portal EnergetikaRS revealed that from 2006 to October 2013, the Banja Luka "Toplana" paid 158 million KM to the company H.I.G.A.T. for about 50,309 tons of fuel oil, which was several million KM more expensive than the offers from other bidders during that period.
