Halilović: A civic-democratic constitution is the permanent solution for BiH

(Patria) - BiH is currently facing a security-political crisis, stated the introducer of today's session of Krug 99, Enver Halilović, former rector of the University of Tuzla.

We present Halilović's address in its entirety:

(a) The current actions of the leadership of Republika Srpska and state authorities constitute a classic secessionist coup d'état against the constitutional-legal sovereignty and territorial integrity of BiH. The BiH Constitution, Court and Prosecutor's Office, and the State Investigation and Protection Agency are suspended. This is a textbook example of secession of a part of the territory from the rest of the state, which is practically a secessionist anti-state security act.

(b) The HDZ BiH's demand for so-called legitimate representation and election is a separatist demand on behalf of one nation, which could also, at some stage, escalate into a security problem. The political representatives of HDZ, members of the leadership of repressive authorities, do not support bringing the leadership of Republika Srpska to justice.

Neighboring countries Serbia and Croatia, as signatories to the Dayton Agreement, are directly involved in both crises in BiH, based on their so-called special relations with the entities of BiH. They have internationalized their national interests in BiH, the so-called protection of the Dayton competencies of Republika Srpska, or ensuring the so-called legitimate interests of Croats, to all addresses worldwide.

The war-time ethno-political idea of the Dayton Constitution concerning three ethno-biological nations in BiH is the official, constitutional-legal platform for the permanent Bosnian-Herzegovinian political crisis of post-Dayton Bosnia. The BiH Constitution places nations in mutual confrontation and within it, we seek mechanisms for their mutual protection through inter-ethnic and entity vetoes. The current security-political crisis cannot be permanently resolved through the mechanisms of the ethnic-entity constitution of BiH and the work of state institutions built on the ethnic constitution. This is confirmed by the dismissals of Prlić on one side, and Poplašeni and Šarović on the other. Instead of them, after their dismissals, Čović and Dodik are working on and acting on the same projects.

State administrative-institutional bodies of authority, the court, police, and armed forces of BiH are not constituted, neither in leadership nor in the structure of employees, on functional principles of work and the ability to perform the tasks for which they exist.

Considering the judgments of the International Criminal Tribunal for the former Yugoslavia in The Hague regarding the character of the war in BiH from 1992-1995, its judgments on two joint criminal enterprises, the past functioning of BiH under the Dayton Constitution, six judgments of the European Court of Human Rights, and the judgments of the Constitutional Court and other courts in BiH, as well as the current political-security situation in the country, I believe that amending the discriminatory, ethno-political Constitution of BiH to a civic democratic constitution is the only path to a permanent solution for building the political-legal order of Bosnia and Herzegovina.
