Form a patriotic front to stop unconstitutional behavior of part of the RS authorities

The Collegium of the SDA Presidency, at today's session, considered the implications of the referendum scheduled for September 25 this year in RS and adopted certain conclusions, writes Patria.

The decision of the National Assembly of RS to schedule a referendum on September 25 represents the most flagrant violation of the BiH Constitution and the Dayton Peace Agreement since its signing. This is the first anti-Dayton referendum; the President of RS, Milorad Dodik, stated that a referendum on the "self-determination of RS" would be organized "sooner or later." The last SNSD Congress adopted a Declaration titled "Free and Independent Future and Responsibility," which calls on the National Assembly of RS to call a referendum on the independent status of RS during 2018 – the conclusions state.

Furthermore, SDA concludes that the referendum scheduled for September 25 is a trial balloon for a referendum on the secession of RS from BiH. The beginning of the destruction of the peace agreement accepted in Dayton 20 years ago is the beginning of the destruction of peace in BiH; this is planned to be done on September 25 this year. The destruction of the peace agreement will inevitably lead to the destruction of peace in BiH and possibly in this part of Europe; this is planned to be done in 2018.

The SDA Collegium warns and calls on the forces of law to energetically and immediately oppose the forces of lawlessness. Everyone must do what they are mandated to do, what they are paid for, and what the law obliges them to do.

- There can be no peaceful separation in BiH, no separation of any kind; Srebrenica, Tomašica, Keraterm, Manjača, all places of suffering of innocent people, nor any part of BiH, will ever be separated from the territory of BiH. The forces of separatism that lead to conflicts with unforeseeable consequences must be bravely stopped before they gain momentum. We call on the OHR and the Peace Implementation Council to take concrete steps and actions to protect the Dayton Peace Agreement, in accordance with their obligations and authorities – SDA states.

OTHER CONCLUSIONS

·         We call on the Constitutional Court of BiH to react by introducing necessary temporary measures and annulling the decision of the National Assembly of RS, which is unconstitutional and contrary to the decision of the Constitutional Court of BiH; We also remind the Constitutional Court that the legal deadline of 6 months has passed within which the National Assembly of RS should have adopted amendments to the Law on Holidays; instead, a number of officials in the institutions of this entity have engaged in activities to prevent and obstruct the execution of the verdict, which is punishable by the Criminal Code of BiH, and we expect the Constitutional Court of BiH to inform the BiH Prosecutor's Office to take measures provided by law.

·         We warn the BiH Prosecutor's Office that officials in the National Assembly of RS, and in a number of other RS institutions, have undertaken activities that constitute a criminal offense described in Article 239 of the Criminal Code of BiH – they refused, prevented, and otherwise obstructed the execution of the executive decision of the Constitutional Court of BiH.

·         We warn members of the Central Election Commission and municipal election commissions that the eventual handover of voter lists to the RS authorities for the purpose of organizing an unconstitutional referendum would also constitute a criminal offense punishable by Article 239 of the Criminal Code of BiH.

·         We call on deputies and delegates in the BiH Parliament, the Parliament of the Federation of BiH, the National Assembly of RS, and the Council of Peoples of RS to, regardless of party affiliation, form a massive patriotic front that will stop the adventurous, unconstitutional, and illegal behavior of part of the RS authorities, and stabilize the situation in BiH.
