Feraget to Avdić: Please do not write about the 'Memić case' when you did not do so in previous years either

Lawyer Ifet Feraget sent an open letter to journalist Avdo Avdić regarding an article published on February 3, 2021, at 1:00 PM on the portal „Oslobođenje“, under the title: „When you build a reputation on someone else's tragedy / What was actually resolved in the Memić case?

"As the lawyer for the Memić family, I am reacting to protect the interests of the investigation by the Prosecutor's Office of Bosnia and Herzegovina in this extremely sensitive case, and to protect the interests of Mr. Muriz Memić, I am reacting as a human being to the written drivel. To be completely precise, by drivel I mean the deliberate presentation of half-truths (mixing lies with truth) with the aim of making the lies more convincing by presenting them, while only presenting parts of the truth if they serve that purpose (to make the presented lie more convincing)! 

“Avdo is a male name of Arabic origin. The name is derived from the name Abdullah. The name denotes Allah's slave, servant, an honest, creative, and spiritually strong personality, capable of loving with a pure heart”!

You write, “that you understand Muriz Memić because his child was killed and those who were supposed to find the killers did not do their job.” Your goal is to make the presented lie “that those who were supposed to find the killers did not do their job” more convincing, even though you know that members of the Ministry of Interior of Sarajevo Canton (Report of the Ad hoc body of the Security Commission of the Assembly of Sarajevo Canton) and the Cantonal Prosecutor's Office of Sarajevo Canton (two acquittals by the Cantonal Court of Sarajevo Canton) consciously and deliberately tried to cover up this obvious murder!

So, it is one thing when the competent authorities “do not do their job” (i.e., do not conduct a proper investigation that must establish all relevant facts and, when possible, lead to the identification of the perpetrator, which is possible here), and a completely different thing when the competent authorities destroy and hide evidence and plant false leads (so that the investigation never leads to the perpetrator)! 

Further, you write that “the problem is not that Saša Magazinović took a photo with Muriz Memić, but the real problem is the actions of the Prosecutor's Office of Bosnia and Herzegovina, which, on the fifth anniversary of the murder (or death) of Dženan Memić, conducted a lightning-fast operation against members of the Ministry of Interior of Sarajevo Canton, Hasan Dupovac and Zijad Mutap, the father of Alisa Mutap who was with Dženan that tragic evening and remembers nothing, because they tried to find a green Renault Clio car which, it would later turn out, was not the object of the criminal offense, as well as against two members of the Directorate for Coordination of Police Bodies, Nedžad Hrvat and Nebojša Veljović, because they failed to timely inform the authorities that, besides Alisa Mutap, Dženan Memić also sustained serious bodily injuries! Finally, you conclude that “the Prosecutor's Office of Bosnia and Herzegovina has not resolved the Memić case”!

Let's go in order, Mr. Avdić!

You write “murder or death”! Your goal is to make the presented lie that it might be a death more convincing, even though you know that the Cantonal Court of Sarajevo Canton has already twice established in its verdicts that the Cantonal Prosecutor's Office of Sarajevo Canton did not prove that a traffic accident occurred at all (the evidence presented at the main trial does not provide sufficient grounds for the court to conclude that all the facts from the description of the mentioned criminal offenses, which establish the essential elements of the criminal offenses, exist)!

You write that “Alisa Mutap remembers nothing”! Your goal is to make the presented lie that Alisa Mutap had amnesia more convincing, even though you know that the Cantonal Court of Sarajevo Canton has already twice, “based on expert findings, established that Alisa Mutap does not have amnesia and that if she did have short-term fragmented amnesia, with such amnesia memories would quickly return, so the court became convinced that she knows what really happened but does not want to say it“! Is it even necessary to state that in the absence of a traffic accident, there is no amnesia as a consequence of a non-existent traffic accident!  

You write that Dupovac and Zijad Mutap “are charged with trying to find a green Renault Clio car which, it would later turn out, was not the object of the criminal offense”! Your goal is to make the presented lie that some car was indeed the object of the criminal offense more convincing, even though it is more than clear that in the absence of a traffic accident, a car cannot be the object of a criminal offense of a non-existent traffic accident!

Further, you write that two members of the Directorate for Coordination of Police Bodies, Nedžad Hrvat and Nebojša Veljović, are charged because they failed to timely inform the authorities that, besides Alisa Mutap, Dženan Memić also sustained serious bodily injuries” and finally you conclude that “the Prosecutor's Office of Bosnia and Herzegovina has not resolved the Memić case”! Your goal is to make the presented lie that the late notification to the authorities (emergency services) that Dženan (who was lying in blood) also sustained serious bodily injuries has nothing to do with the death of Dženan Memić more convincing! The real truth is that the Cantonal Prosecutor's Office of Sarajevo Canton possesses a video surveillance recording showing that Alisa and Dženan arrived at Velika aleja at 9:30 PM, and the emergency services (JU ZHMP) received the call for intervention at 10:37 PM. The medical team at 10:52 PM first provided assistance to a less injured female patient, and only then, at 10:53 PM, the medical team was informed by the present police officers that there was another more seriously injured male person in an unconscious state! Dženan was brought to KUM around 11:30 PM and operated on at 12:30 AM the next day, i.e., February 9, 2016. I hope you understand that Dženan might be alive today if „Alisa did not have amnesia“ and if the police officers had called emergency services on time! I also hope you understand that “the Prosecutor's Office of Bosnia and Herzegovina has not resolved the Memić case” because it has not yet completed the very detailed investigation it is conducting!

It is not always: Nomen est omen! I will not deal with whose servant you are, but what you have written is not fair! If you were honorable and creative, you too, like other journalists, would help the family solve this murder (that is the role of objective investigative journalism)! If you were spiritual, you would seek the meaning of life in the hope that this case (like the case of the murder of David Dragičević and other cases) is resolved as soon as possible (as Mr. Slobodan Vasković demands)! If you had a pure heart, you would look up to Muriz Memić, Davor Dragičević, and other parents, who only do what must be done, find and punish the murderers of their children! Because of all this, the question arises: Are you even Avdo?

Finally, let me also ask you once more, as my client, Mr. Muriz Memić, has already asked you, not to write anything more about the Dženan Memić case since you did not write about it in the previous five years (as long as my struggle to help the Memić family has lasted)!", states Ifet Feraget.
