Federal Prosecutor's Office rejects Nikšić's request: We do not encroach on the right of the FBiH Parliament to hold a session and debate

(Patria) - In connection with the Request of the Government of the Federation of Bosnia and Herzegovina, submitted to the Federal Prosecutor's Office of the FBiH on November 17, 2025, seeking an opinion from this Prosecutor's Office regarding the holding of the 16th extraordinary session of the House of Representatives of the Parliament of the Federation of Bosnia and Herzegovina, the Collegium of the Federal Prosecutor's Office of the FBiH took a stance at today's session and informed the Government of the Federation of Bosnia and Herzegovina accordingly.

We convey the response in full:

"Regarding your request number: 03-08-1911/2025 dated November 17, 2025, the Federal Prosecutor's Office of the FBiH held a Collegium of prosecutors and took the following stance on the aforementioned issue:

"All individuals and institutions in BiH/FBiH are expected to behave in a manner that avoids commenting on specific evidence and investigative procedures that are ongoing before any police authorities or prosecutor's offices in BiH/FBiH.

The fact is that, in the specific case, a significant amount of evidence reached the public before the formation of the prosecutor's investigation and was already the subject of public commentary by both the media and a significant number of politicians and individuals even before the formal initiation of the investigation, so in that segment it would be pretentious to claim that a debate on the aforementioned before the House of Representatives of the Federal Parliament could jeopardize the integrity of the said investigation, especially since the proposed agenda item is broadly set and can even be distanced from the evidence presented in the specific case.

It is the duty of the legislative, executive, and judicial authorities to act within their constitutional and legal powers, while the Federal Prosecutor's Office of the FBiH will take care of the integrity of the investigation, without encroaching on the right of the Parliament of the FBiH to debate issues within its competence," the response states.
