Emrić: Konaković's toxic vocabulary shows his unpreparedness to face facts and arguments

(Patria) - We hope that from tomorrow we will start a new chapter so that our homeland becomes a democratic, full member and prosperous member of the EU, announced NES MP in the BiH Parliament Jasmin Emrić.

- I welcome the fact that the Council of Ministers of Bosnia and Herzegovina removed the Draft Law on the Court of Bosnia and Herzegovina from the agenda of yesterday's 43rd session, because it is a very bad proposal in which even the name of the law is incorrect.

A hybrid model is proposed, which regulates the continuity of the existence of the Court of Bosnia and Herzegovina and the establishment of the Appellate Division of the Court of Bosnia and Herzegovina as a second-instance body.

In yesterday's comment, the Minister of Foreign Affairs Elmedin Konaković said that the positions are diametrically opposed when it comes to the seat and jurisdiction of the Appellate Court of BiH.

Therefore, I feel obliged to correct the statements of the esteemed Minister Konaković, because the Draft Law on the Court of Bosnia and Herzegovina, which they considered yesterday, does not even provide for the establishment of an Appellate Court as a separate second-instance court, but Article 2 stipulates that court authority at the level of Bosnia and Herzegovina is exercised by the Court of Bosnia and Herzegovina and the Appellate Division of the Court of Bosnia and Herzegovina.

I warn Minister Konaković to take into account that a court and a division of a court are not even remotely the same, neither organizationally nor functionally.

Minister Konaković stated that they are 'splitting hairs when it comes to jurisdiction', but the fact is that the Draft Law on the Court of Bosnia and Herzegovina has removed jurisdictions that are prescribed by the valid Law on the Court of Bosnia and Herzegovina.

Therefore, it would be more useful if Minister Konaković, transparently and responsibly to the entire public, explained these specific proposed changes that the 'Trojka-SNSD-HDZ' coalition parties are agreeing upon in relation to the valid law, instead of, in the absence of arguments, insulting those who point out the controversial provisions that significantly reduce and limit the jurisdiction of the Court of Bosnia and Herzegovina.

Due to our effort to kindly and timely share our position and criticism of the controversial legal provisions of the Draft Law on the Court of Bosnia and Herzegovina, Minister Konaković, in the absence of dialogue culture, inappropriately and shamelessly calls us "malicious people and political vultures who are preying on these processes".

The unscrupulous rhetoric and toxic vocabulary used by Minister Konaković shows his unpreparedness to face the facts and arguments that point to the weakness of the legal solution they are agreeing upon with coalition partners, and his condescension towards Milorad Dodik's specific demands regarding the jurisdiction of the Court of Bosnia and Herzegovina.

Resorting to calling specific and stated articles and provisions of the Draft Law on the Court of Bosnia and Herzegovina "notorious falsehoods", which can be verified by reading the text, shows all the arrogance, lack of knowledge of the subject matter, and absence of self-control of the esteemed Minister Konaković.

In order to determine what is true, I suggest that Minister Konaković read, and several times, the text of the Draft Law on the Court of Bosnia and Herzegovina, but with understanding, because it is a complex normative legal matter.

Also, I must remind Minister Konaković that we are not, nor are we running away from, the responsibility of making decisions, and therefore we could not accept being represented by a bungler who, in a rambling fervor, fancies himself to be doing a good job that he is not up to.

As for the European path of Bosnia and Herzegovina, although we had specific criticisms and objections, we supported all laws that met the minimum European requirements and standards, and we expect that tomorrow the European Council will accept the proposal of the European Commission and give Bosnia and Herzegovina the green light to start the negotiation process towards full membership in the European Union.

The European path has no alternative for us, and we hope that from tomorrow we will start a new chapter so that our Homeland also becomes a democratic, full member and prosperous member of the European Union - Emrić stated.
