Džaferović: Proposals of laws from RS parties will not pass

At the session of the House of Representatives of the Parliamentary Assembly of Bosnia and Herzegovina on January 12, the SDA will not support two proposed laws from the SDS and SNSD, namely the Proposed Law on the Constitutional Court of Bosnia and Herzegovina and the Proposed Law on amendments to the Criminal Code of Bosnia and Herzegovina, said Šefik Džaferović, Deputy Chairman of this House, for the news agency Patria.

Džaferović emphasizes that these proposals will certainly not pass, because they will not have the entity majority from the Federation of Bosnia and Herzegovina.

-The Proposed Law on the Constitutional Court of Bosnia and Herzegovina abolishes the autonomy of this court, introduces ethnic voting, and excludes foreign judges from the court's work. If this were to happen, the balance would be disrupted given the internal structure of Bosnia and Herzegovina and the complicated way of making decisions. That is the already established practice of taking from Dayton what suits them and rejecting what does not.

When it comes to the Proposed Law on amendments to the Criminal Code of Bosnia and Herzegovina, that non-implementation of decisions of the Constitutional Court of Bosnia and Herzegovina and the Court of Bosnia and Herzegovina should not be sanctioned, that is simply unknown in legal practice. We generally have a problem with a large number of unenforced decisions of the Constitutional Court of Bosnia and Herzegovina, and we not only should not abolish existing sanctions, but we should devise new legal mechanisms to implement the decisions, explains Džaferović.
