
(Patria) - DF delegate in the House of Peoples of the BiH Parliament Dženan Đonlagić reacted to the US Embassy's accusations that the Bosniak Caucus, led by SDA, is blocking the work of the House of Peoples.
"So the problem is not delegates from SNSD, HDZ and SDS who include a Law that dismantles the Constitutional Court of BiH on the agenda, but the Bosniak People's Caucus?! And all by outvoting all 5 delegates. Why? You previously called on MP Kožul to withdraw the Law on Salaries (cash salary payments), so you could have also called on delegate Nešković regarding the unconstitutional text of the Law on the Constitutional Court," said delegate in the House of Peoples of the Parliamentary Assembly of BiH Dženan Đonlagić.
He pointed out on social network X that he will not participate in the discussion regarding the Law on the dismantling of the Constitutional Court of BiH.
"First, Nešković's proposal is unconstitutional and second, its content is also contrary to the Opinion of the Venice Commission. In the BiH Parliament, they want to adopt a Law that will turn the Constitutional Court into some new House of Peoples," said Đonlagić.
"It all started when Nikola Špirić chaired the House of Peoples, and it continues now that Dragan Čović took over the position of chairman in mid-June," he recalled.
"The problem is also in the intention of the delegates of the Serb People's Caucus, supported by delegates from both HDZs, to change the decision-making system of the Constitutional Court of BiH in a way that it becomes ethnic and territorial (entity-based) decision-making. This is completely unacceptable. Ethnic quotas or criteria for the election of judges of the Constitutional Court of Bosnia and Herzegovina represent an expression of new discrimination. The ethnic decision-making system, as well as the territorial, i.e., entity decision-making system, cannot be applied to the decision-making process of the Constitutional Court of Bosnia and Herzegovina," Đonlagić emphasized.
"The Constitutional Court, as the highest judicial instance in the country with specific competencies that makes decisions concerning all citizens of Bosnia and Herzegovina, should make its decisions by a simple majority of the total number of judges. The Constitutional Court of BiH is for all citizens, not for specific ethnic groups," Đonlagić concluded.
