Đonlagić on Continuation of the House of Peoples Session of the BiH Parliamentary Assembly: We Will Not Participate as Long as the Dismantling of the Constitutional Court is on the Agenda

(Patria) - The continuation of the 14th session of the House of Peoples of the BiH Parliamentary Assembly, which was interrupted on March 18 because the agenda included the Proposal of the Law on the Constitutional Court of BiH by delegate Želimir Nešković (SDS), after which the Bosniak Club left the session, is scheduled for October 8.

From March until today, two emergency sessions were held, and at the July session, the Budget of BiH Institutions and amendments to the Law on the High Judicial and Prosecutorial Council and the Law on Public Procurement were adopted. Although the continuation of the 14th session was also scheduled for June 27, there was no quorum for work.

The proposal that was placed on the agenda thanks to the votes of the Serb Club and the Croat Club (except Zlatko Miletić) stipulates that the judges elected by the President of the European Court of Human Rights be replaced in such a way that the House of Representatives of the Federation of BiH elects two judges to the Constitutional Court of BiH, and the National Assembly of the Republika Srpska elects one judge who will take over the function from the current three foreign judges.

Dženan Đonlagić, a delegate of the Democratic Front in the Bosniak Club, told Patria that he will not participate in this session.

"As long as the content of the unconstitutional proposal of the law on the Constitutional Court of BiH is on the agenda, we do not participate. The state is not a lottery to be toyed with. Dismantling the Constitutional Court of BiH is dismantling the state. Any agenda without this item is welcome, especially laws from the European agenda, which the government does not propose," said Đonlagić.

In a statement she previously gave to the media, delegate Marina Pendeš (HDZ BiH) said that they would reject that law, and that they only voted for the urgent procedure.

„We have said, not once, but several times, that by voting for the urgent procedure, we will subsequently reject that law, so that there will be no more talk about that law at all. I don't know what the fear is about. It cannot pass the House of Peoples. And even if in the worst case it passed, and the Croats will not vote for it, it cannot pass in the House of Representatives," stated Pendeš.

However, for the Bosniak Club, it is problematic that such a law was placed on the agenda at all.
