Document Annex 4 from 2012: Dodik's Plan for Breaking Up the State of BiH According to Instructions from Foreign Lobbyists

The Social Democratic Party of BiH strongly emphasizes that the state of Bosnia and Herzegovina has been a permanent political, legal, and historical fact since its inception. The continuity of BiH's statehood was not denied even by the Dayton Peace Agreement, and therefore it is high time that officials of the BiH entity of the RS finally understand the elementary constitutional and legal fact that this entity is an administrative-territorial unit within the sovereign and indivisible state of BiH, which as such has existed only since the signing of the Dayton Peace Agreement, announced the SDP BiH, as reported by the Patria news agency.

-Any attempt to establish continuity of the BiH entity of the RS with unconstitutional, illegal, unrecognized, and self-proclaimed creations represents a legally unfounded, dangerous, and flagrant violation of the explicitly prescribed provisions of the Dayton Peace Agreement and the Constitution of BiH.

The BiH entity of the RS has never been a state, is not one now, and will never be a state. Entities in BiH exist solely on the basis of the Constitution of the state of BiH from 1995. Therefore, the illegal and self-proclaimed RS in 1992 was an anti-constitutional and para-state creation, which did not exist either in the internal legal order of BiH or in the international legal order. Only with the signing of the Dayton Peace Agreement was the RS legitimized by the will of the BiH Constitution as one of the entities in our state.

It would be naive to think that the continuous and increasingly brutal attacks from the BiH entity of the RS on the sovereignty, statehood, and constitutional order of the state of BiH are the result of spontaneous, unplanned, and uncoordinated moves. Obviously, these are planned and prepared projects and activities that undermine the very foundations of the Dayton Peace Agreement and the Constitution of BiH.

Therefore, at the last session of the House of Representatives of the Parliamentary Assembly of BiH, SDP deputies asked the Chairman of the Council of Ministers of BiH whether he was familiar with the document titled “Annex 4 – modeled after the US Constitution. The manner of creation and survival of Bosnia and Herzegovina,” which unconstitutionally, unscientifically, unarguably, and maliciously interprets the statehood, history, and legal order of BiH.

Given the interest of the media and the wider public in the content of this document, SDP BiH has decided to make it public and deliver it in its entirety to the media, bodies and institutions, political officials, and other interested citizens. We publicly call on the leaders of the BiH entity of the RS to answer the questions: who are the real authors of this document, who commissioned it, for what specific needs was it compiled, how much was paid for it by taxpayers…

At the same time, regardless of the views and assessments of the leaders of the BiH entity of the RS, we remind that the content of this document largely coincides with the years-long destructive political rhetoric and concrete activities of the president of the smaller BiH entity, Milorad Dodik, and his followers.

This document clearly reveals why Milorad Dodik has persistently repeated anti-Dayton and anti-constitutional theses in recent years, such as that “BiH is a consensual state created in Dayton,” that there is “an independent Republika Srpska within Dayton BiH”…
