Dodik, games around the Drina and state property, manipulations and lies leading to conflict!

Milorad Dodik, president of the SNSD and member of the BiH Presidency, yesterday only briefly, speaking about his insane venture of transferring competencies from BiH to the RS, mentioned 'that it was not he who took away the forests and the Drina from the RS, but the Constitutional Court of BiH'.

And as if casually uninterested, he sent a message about what interests him, and that is ownership of land, which he subconsciously surely knows he cannot obtain!

The whole game is about the Drina, land, construction of hydroelectric plants, and ownership of forests, which Dodik has already placed as collateral for a loan of 600 million!

The six-month deadline ahead of him will certainly be used precisely to achieve full control and impose his policies when it comes to resolving the issue of state property.

And he does not do this on legal grounds, but through manipulations and distortions of legal bases, just as he manipulates the transfer of competencies and the invocation of the original Dayton. But everyone silently watches his red lines and crosses them together with him. From domestic judicial institutions that have no adequate response, to mild warnings from foreign factors and mentions of sanctions that are in drawers.

We remind you of Dodik's manipulations who, speaking about the ruling of the Constitutional Court of BiH on agricultural and forest land in the RS, which was declared unconstitutional, calls it absurd, because according to his words, the Constitutional Court earlier confirmed with its decision that the Brčko District is the owner of agricultural land and forests.

However, the ruling U1/11 Paragraph 81 clearly states:

„Having in mind the aforementioned, the Constitutional Court concludes that the RS adopted the disputed law (Law on Resolving the Status of State Property) contrary to Article 1/1 of the Constitution of BiH (state continuity) and Article III/3 point b (additional competencies of the state of BiH) which expresses the principle of constitutionality, as well as Article IV/4e (constitutional competencies for the protection of sovereignty and territorial integrity of BiH), which assigns the Parliamentary Assembly competence in other matters necessary for the implementation of state duties, because it concerns the exclusive competence of BiH to regulate the issue of property from Article 2 of the disputed law. For these reasons, the contested law is unconstitutional. The entire law cannot remain in legal force together.

This conclusion is not affected even by the fact that the Brčko District of BiH adopted the Law on Public Property of the Brčko District of BiH, with its specific solutions. This law has not been challenged before the Constitutional Court of BiH, nor is it the subject of a request for constitutional review (in the specific case). Therefore, the Constitutional Court cannot enter into examining the competence for reviewing this law (of the Brčko District). Any opposite approach could lead to prejudging this issue, which is not in accordance with the working method of the Constitutional Court of BiH, which is based 'on the principle of requests'!.

This entire manipulation is precisely the challenging and ignoring of the constitutional principle of state continuity of BiH from Article 1/1 of Annex 4 of the Dayton Peace Agreement, while favoring the concept of a composed state which he carefully defended by imposing the possibility of its acceptance.

This is how he operates with lies about the original Dayton and the return of some competencies from the level of the state of BiH to the entity of the RS.

Article 1, paragraph 2 is completely clear, the Republic of Bosnia and Herzegovina was a subject of international law that signed an international agreement, no entity was nor will be a subject of international law, and Dodik is doing this extensively, thereby abandoning the Dayton Peace Agreement!
