DETAILS OF THE INDICTMENT Azur Terzić fell from a height of 4 meters due to negligence, the object owner is accused of hiding camera footage

(Patria) - By the decision of the Municipal Court in Cazin dated 02.11.2023, the indictment against Aida Durić, Andy Durić, and Emir Horozović from Cazin was confirmed for the criminal offense of Serious Criminal Offenses against the general safety of people and property, in connection with the criminal offense of Causing General Danger, in conjunction with the prolonged criminal offense of Preventing Evidence in connection with incitement, and in connection with the serious bodily injuries sustained by young Azur Terzić on October 02, 2022.

In the conducted investigation in this case, after hearing 70 witnesses and conducting numerous expert examinations, it was determined that it was not a physical attack on the injured party, but a fall from a height of 4 m in an unsecured facility owned by the shopping center owner.

The accused are charged with, to the degree of reasonable suspicion: Aida Durić, alone, starting from an undetermined date in 2022 until 02.10.2022 at 01:45 AM in Cazin, Mala Lisa bb within the premises of the company d.o.o. “City Center “ Cazin as the majority owner and responsible person, contrary to the Law on Construction and the Law on Spatial Planning, which stipulates that the owner of a building is obliged to maintain the building safely, allowed that on the first floor of the building, which is visited daily by a large number of people, in the immediate vicinity of shops, a children's playground, and a disco, there were unsecured doors without locks, which were constantly ajar, leading to a corridor 9 m long ending with unsecured and unlocked doors leading directly to the exterior of the building and into a 4 m deep pit.

Despite warnings from employees that such doors posed a danger, the accused forbade them from removing the key from those doors. On the night of 02.10.2022, around 01:40 AM, after leaving the disco, the injured party Azur Terzić, looking for his friend to go home together, walked down the corridor towards the unlocked doors, not knowing they led into a pit. Upon passing through the doors, he fell from a height of 4 m onto the back of his body, sustaining life-threatening serious bodily injuries to his head, injuries to his thoracic spine, and a complete transverse rupture of the spinal cord, resulting in complete paralysis of the lower extremities, rendering him immobile.

Therefore, the accused negligently, as a responsible person, failed to act according to regulations or technical rules on protective measures, thereby causing danger to human life, as a result of which one person was seriously injured.

The accused Aida Durić and Andy Durić, together, after the injured party fell, before the arrival of the investigation team, aware that they were inciting another to commit a criminal offense by abusing their subordinate relationship with the security guard, the accused Emir Horozović, ordered him to lock the doors, remove the key from the lock, and thereby prevent evidence, which he did willingly, and removed the key from the lock, but did not throw it away, instead leaving it in a drawer with other keys.

Therefore, Aida and Andy Durić incited another to commit a criminal offense, and the accused Emir Horozović hid another's item that serves as evidence.

The accused Aida Durić, within the premises of the shopping center “City Center Cazin”, although ordered by the court to hand over all video recorders to obstruct the evidence procedure, knowingly handed over one device, and hid the one that covered the other floor of the disco and the outdoor terrace.
