Delegates of the House of Peoples submitted a request to the Constitutional Court of BiH for a review of the constitutionality of the Law on FTV and the appointment of the Management Board

(Patria) - We have submitted a request (appeal) to the Constitutional Court of Bosnia and Herzegovina for a review of compliance with the BiH Constitution of certain provisions of the Law on the Public Service of Radio-Television of the Federation of BiH, in connection with the Decision on the appointment of the Management Board of FTV, announced Muamer Zukić, President of the Bosniak Caucus in the House of Peoples of the Parliament of the FBiH.

"We believe that certain provisions of the Law on the Public Service of Radio-Television of the Federation of Bosnia and Herzegovina are extremely unclear, imprecise, and as such unenforceable, which threatens the constitutional principles of legal certainty and the rule of law… along with many other disputed elements that we have elaborated in the appeal. We believe we have offered solid arguments on several dozen pages of text, and considering the previous practice of the state constitutional court in similar cases, we count on a positive outcome," Zukić states.

"We also requested an interim measure to suspend the disputed provisions of the law and the mentioned appointment decision, pending the final decision of the Constitutional Court in this case. In addition to the above, a document is being prepared to initiate another legal proceeding, this time at the level of the Federation of BiH, which is also related to the disputed appointment of the FTV Management Board. Given that one quarter (1/4) of the delegates of the House of Peoples of the Parliament of the Federation of Bosnia and Herzegovina was required to submit this appeal, I particularly emphasize the role of colleagues (26 of them) who signed the request, whose names are indicated in the documents attached. For almost two years, I have had the honor of leading the Legal Council of the SDA BiH, which does a great job ‘behind the scenes’ and without public attention, and I take this opportunity to highlight the role of legal colleagues in preparing this appeal," Zukić stated.
