Crnalić: Detention was ordered due to public disturbance, I will appeal because there is no evidence for it

The construction company „Famus gradnja 3“ from Tešanj has a hundred employees, and since the tragedy in Sarajevo when two workers of this company died and one was seriously injured while performing works on a building in Hiseta street, none of their construction sites have been operational, writes the Patria News Agency.

By the proposal of the Cantonal Prosecutor's Office, detention was ordered for Kemal Karahmet, director of the Tešanj company "Famus Gradnja 3", technical director Miralem Jahić, and construction site manager Dženan Hadžemu.

Detention was ordered for the suspects due to the fear that, due to the severity of the committed criminal offense, their freedom could cause public disturbance.

Asim Crnalić, the lawyer of the director of "Famus Gradnja 3", says that he has not yet received the decision, but that he will file an appeal within three days, as stipulated by law.

He confirmed that the other construction sites of this company will be open tomorrow (there are several in Sarajevo), but he cannot confirm how everything will function without the director.

-Detention was ordered due to public disturbance, and it should be added that detention was also ordered due to the expected disruption of public order and peace if they were to defend themselves while at liberty.

There is no evidence whatsoever that people would protest if they were to defend themselves while at liberty. This is an arbitrary stance of both the Court and the Prosecutor's Office, because to reach such a conclusion, there needs to be something, and there are no demonstrations, nothing. How can I conclude that public order will be disturbed because they will defend themselves while at liberty.

Only if there are attempts to put pressure on the Court or the Prosecutor's Office now, but there is none. Public disturbance is related to something else, the public is disturbed by the event, but that has nothing to do with ordering detention. Only if there is a disruption of public order is there a legal basis for ordering detention – says Crnalić.

The construction site in question, where Enes and Ramiz Halilović lost their lives, will not be operational until further notice, and Crnalić is trying to secure an expert examination from the Construction Institute.

The culprit must be held accountable 

It is clear that responsibility and guilt must be determined regarding the fall of formwork from the top of the building, which also pulled down the scaffolding, and that the culprit must be punished, but the workers who earn their living in this company are worried about their existence.

-I think the problem is much bigger in the state itself, because no one is asking who supervised the works, the inspection must also be held accountable. It's not just about our company. Honestly, we are afraid, because how will we feed our families now, who will sign our salaries. We agree that this area should be regulated, because our lives will also be in danger tomorrow – says a worker of "Famus gradnje" who requests anonymity.
