(Patria) - President of the HJPC Sanin Bogunić spoke in the FTV Mreža magazine about the current situation in BiH, the state of the judiciary, the HJPC, and the work of the BiH Prosecutor's Office in the case of attacks on the constitutional order in which Milorad Dodik, Nenad Stevandić, Radovan Višković are suspected...
Are the Prosecutor's Office and judicial institutions afraid of this situation and are they delaying the arrest of Stevandić, Višković, and Dodik if they do not respond to the court summons?
I believe that the Prosecutor's Office fears no one, nor do these prosecutors fear anyone; rather, they want to respect the legally prescribed procedures, just like with all other citizens of this country, and believe me, that is very important. Therefore, the law, or rather, the laws, must apply equally to all people. I do not know the health status of any of the individuals you are listing, but I completely trust our prosecutors.
Our judicial system is strong enough to respond appropriately to every individual and collective. The Prosecutor's Office will bring this case to an end, and the state will come for everyone, do not doubt it.
What if, in the end, this trio does not respond to the BiH Prosecutor's Office? And they continue to say that they do not recognize the Prosecutor's Office, the Court, or SIPA, and that their activities are prohibited in the territory of Republika Srpska.
You have the procedures I described. They are very clear, and the Prosecutor's Office, or rather, the law enforcement agency, will certainly act according to them. I understand a certain impatience from some structures, but let's let the Prosecutor's Office and the Court do their job in the legally prescribed manner.
Will the Prosecutor's Office ask SIPA to react if they do not respond to the summons?
According to the Criminal Procedure Code, SIPA is one of the agencies that undertake evidentiary actions on the orders of the Prosecutor's Offices. There are other agencies as well, and I really don't know whom the Prosecutor's Office will choose and how they will realize their requests and orders in this case.
And whom can they choose besides the court police? Is it SIPA?
You have agencies at the state level, the Border Police, and hypothetically, entity agencies are clearly listed in the Criminal Procedure Code itself.
It is known who the authorized officials are. You have multiple agencies, you have the Directorate for Coordination of Police Bodies... There are multiple agencies that implement the orders of the Prosecutor's Offices.
How do the HJPC, the Prosecutor's Office, and the Court work?
We work, so to speak, completely normally, although that should also be a given. Employees come and regularly perform their duties from both entities and from Brčko District. As for the Court of Bosnia and Herzegovina and the Prosecutor's Office of Bosnia and Herzegovina, I hear that the situation is roughly the same. I don't have official data, but I know that these institutions are working completely normally.
The Constitutional Court has issued a temporary measure, those laws are currently suspended, so I see no reason why anyone would avoid their work obligations that are prescribed by law, Bogunić told Mreža.
